I. Administrative licensing items (1 item) (I) Fire safety inspection before the commissioning or opening of places for public gathering According to Article 15 of the Fire Protection Law of the People’s Republic of China, before such places are put into use or opened for business, the construction unit or the entity using them shall apply to the fire protection department of the local people’s government at or above the county level where the place is located for a fire safety inspection. The fire protection agency of the public security organs shall, within 10 working days from the date of receiving the application, conduct a fire safety inspection of the premises in accordance with fire protection technical standards and regulatory requirements. Those that have not undergone fire safety inspections or fail to meet the fire safety requirements after such inspections shall not be put into use or operation. Article 8 of the Regulations on Fire Inspection and Supervision (Order No. 120 of the Ministry of Public Security) stipulates that before public gathering places are put into use or operation, the construction unit or the entity using the place shall apply to the fire protection agency of the people’s public security department at or above the county level where the place is located for a fire safety inspection, and submit the following documents: (1) Application form for fire safety inspection ； (II) A copy of the business license or a pre-approval notice for the enterprise name issued by the administrative department for industry and commerce ； (III) Copies of the legal documents relating to the fire safety inspection of construction projects obtained in accordance with the law, or those related to the fire safety registration for project completion inspection ； (IV) Fire safety regulations, fire extinguishing and emergency evacuation plans, site layout diagrams ； (5) Records of pre-job fire safety training for employees, and copies of the professional qualification certificates specific to the fire protection industry held by operators of automatic fire protection systems ； (6) Other materials specified by laws and administrative regulations. In accordance with the Provisions on Fire Supervision and Management of Construction Projects, for public gathering places that do not require fire completion inspection registration but wish to apply for a fire safety inspection, they must also submit the fire design and construction drawings for the interior decoration of the premises, certificates confirming that the fire protection products meet the required standards, as well as documents proving that the fire resistance properties of the decoration materials comply with fire safety technical standards and their factory certification letters. \"Eight Measures Taken by Public Security and Fire Departments to Deepen Reforms and Serve Economic and Social Development\": For public gathering places that meet the application requirements, when the construction unit and the user are the same entity, upon application by that entity, the fire safety inspection for construction projects and the fire safety check prior to the opening for use of such public gathering places are handled together, with separate approval documents issued. II. Administrative Penalties (31 items) (I) For construction projects that are required by law to undergo fire design review by the fire protection agencies of the public security organs; construction is carried out without such legal review or in cases where the review is unsuccessful ； If the fire protection design fails the random inspections conducted by the fire department of the public security authorities in accordance with the law, and construction is not halted ； Construction projects that are required by law to undergo fire safety inspections are put into use without such inspections or fail such inspections ； If, after the construction project is put into use, it fails the random inspections conducted by the fire protection authorities in accordance with the law, yet use of it continues without cessation ； Public gathering places that are put into use or operation without undergoing fire safety inspections, or that fail to meet fire safety requirements after such inspections, are used accordingly ； Penalties for failing to submit fire protection design documents to the fire department of the public security authorities for record-keeping in accordance with the law, or for failing to submit such documents to the same authority for record-keeping after completion of the project. Article 58 of the Fire Protection Law of the People’s Republic of China (revised in 2008): Those who violate the provisions of this Law and commit one of the following acts shall be ordered to suspend construction, cease use, or halt production and business operations, and shall also be fined not less than 30,000 yuan but not more than 300,000 yuan: (1) For construction projects that are required by law to undergo fire design review by the fire protection authorities of the public security organs, starting construction without such review or in case the review is unsuccessful ； (II) If the fire protection design fails the random inspections conducted by the fire department of the public security authorities in accordance with the law, yet construction is not halted ； (III) Construction projects that are required by law to undergo fire safety inspections, which are put into use without such inspections or fail such inspections ； (IV) Failing to cease use after the construction project is put into use and fails the random inspections conducted by the fire protection authorities of the public security organs in accordance with the law ； (5) Public gathering places that are put into use or operation without undergoing fire safety inspections, or that fail to meet fire safety requirements after such inspections, are used or operated without authorization. If the construction unit fails to submit the fire protection design documents to the fire department of the public security authorities for record-keeping in accordance with the provisions of this law, or fails to do so after completion of the construction, it shall be ordered to make corrections within a specified time limit and shall be fined not more than 5,000 yuan.
