Article 19: Special equipment manufacturing units shall ensure that the production of special equipment complies with the requirements of safety technical specifications and relevant standards, and shall be responsible for the safety performance of the special equipment they produce. Special equipment that does not meet safety performance requirements, energy efficiency standards, and those that have been explicitly designated for phasing out shall not be produced. Interpretation of the provision: This article sets out the general obligations of special equipment manufacturing units. It mainly includes the following: 1. Ensuring compliance with the safety technical specifications for special equipment and relevant standards. For the meaning and content of the safety technical specifications referred to in this law, please refer to the definition in Article 8 of this law. Safety technical specifications and the corresponding standards are established to ensure the safety of special equipment, and their compliance is mandatory; only by adhering to these specifications and standards can the safety performance of special equipment be guaranteed. II. Regarding safety performance: The purpose of safety measures for special equipment is to prevent accidents. To ensure the safe operation of such equipment, it is necessary that its safety performance meets the required standards. The safety performance of special equipment includes active and passive performance. Proactive performance refers to the ability of special equipment to prevent the occurrence of failures and accidents, that is, the safety and reliability of such equipment. It is also known as active performance, and it is determined by the materials, structure, parameters, etc. of the equipment itself. Passive performance refers to the ability of special equipment to prevent further escalation of failures or accidents that occur due to the equipment’s own active performance issues or human factors related to safety hazards; in particular, it relates to the capability of protecting people’s lives from harm. This is determined by relevant safety accessories and protective devices. Ensuring the safe and reliable operation of special equipment is the most fundamental requirement, and these requirements are established in safety technical specifications and their corresponding standards. In addition to safety performance, special equipment also needs to have characteristics such as a good appearance and ease of use; these requirements can be further specified in standards or contracts. III. Regarding production units as the main entities responsible for the safety and energy efficiency of the special equipment they produce: Under a market economy system, the entities that carry out economic activities are enterprises. In addition to achieving their corporate goals of maximizing economic profits, these enterprises must also assume certain social responsibilities, such as paying taxes, protecting the environment, ensuring the safety of their employees and others, as well as striving for energy conservation and emission reduction. Therefore, special equipment manufacturing enterprises must not only ensure that the safety, quality, and performance of the special equipment they produce meet the required standards, but also ensure that its energy efficiency indicators satisfy the required criteria – this is true for special equipment. Ensuring safe production and practicing energy conservation and emission reduction are the most fundamental obligations that enterprises must fulfill, with the principal responsible persons of the enterprises being the primary holders of this responsibility. These obligations should be linked to the production activities such as the design, manufacturing, installation, repair, and modification of special equipment in which they are engaged, and they must hold accountability for the consequences of such activities; such obligations should remain in effect throughout the entire life cycle of the special equipment. IV. On energy efficiency indicators for special equipment: Energy efficiency indicators for special equipment refer to the target values (maximum efficiency) and limit values (minimum efficiency) for the energy conversion or utilization efficiency of such equipment products, as determined in accordance with specified testing procedures. **The energy efficiency indicators for various types of special equipment products are published in the form of safety technical specifications or mandatory standards. When manufacturing enterprises indicate the energy efficiency indicators (target values and limit values) of their products in the random documents provided with the products, they shall also specify the operating conditions and circumstances under which these energy efficiency indicators (target values and limit values) are achieved. For example, for coal-fired boilers, it is necessary to specify the technical requirements that must be met in order to achieve the specified energy efficiency targets, such as the load, pressure, and calorific value of the fuel at that thermal efficiency, as well as the requirements regarding the fuel itself. Energy efficiency indicators are one of the most effective means of improving the efficiency of energy conversion and utilization in special equipment and their systems. By setting specific requirements for the energy-saving performance of such equipment, without compromising other characteristics of the products such as performance, quality, and safety, they help to prevent the production, sale, and import of products with low efficiency. This in turn encourages companies to continuously strive to enhance the economic efficiency of special equipment. **Encourage the production of special equipment products (energy-saving products) with production energy efficiency exceeding the target value, and use them under specified conditions to leverage their energy-saving capabilities ; The production, sale, and import of special equipment products whose energy efficiency does not meet the specified standards are prohibited. V. Regarding **special equipment that is explicitly mandated for elimination. **Special equipment that is explicitly designated for elimination refers to those whose safety performance and energy efficiency standards do not meet the requirements of relevant regulations and standards, and which are included in the **List of Special Equipment Products to be Eliminated**. In accordance with the requirements of the Energy Conservation Law, a phase-out system is implemented for outdated special equipment products that consume excessive energy. Strict scrutiny will be applied in the design, manufacturing, modification, inspection, and testing of special equipment to ensure the implementation of the system for phasing out such equipment. For example, the \"Guidelines for Industrial Structure Adjustment (2011 Edition)\\", which came into effect on June 1, 2011 (**Order No. 9 issued by the National Development and Reform Commission**), explicitly listed special equipment such as TQ60 and TQ80 tower cranes, QT16, QT20, and QT25 jib-type tower cranes, as well as coal-fired boilers with fixed grates (except those with double fixed grates) as products subject to phase-out. In response, the General Administration of Quality Supervision, Inspection and Quarantine issued the \"Notice on C canceling the manufacturing licenses for special equipment included in the phase-out list\" (Guo Jian Zhi Te Han [2011] No. 369), ordering quality supervision departments across the country to suspend the issuance of manufacturing licenses for such products and to proceed with canceling the manufacturing licenses of the relevant enterprises.
