Article 32: Special equipment users shall use special equipment that has been manufactured with a license and has passed inspection. The use of **special equipment that has been explicitly phased out and is already scrapped is prohibited. Interpretation of the provision: This article stipulates that entities using special equipment must employ legal special equipment. For entities that use special equipment, utilizing such equipment that has been manufactured with a license and passed inspection is the most fundamental condition for ensuring its safe operation. 1. It is the obligation of users to utilize qualified special equipment. For entities utilizing special equipment, in order to minimize risks as much as possible, they should first purchase products that comply with safety technical specifications, are produced by manufacturers holding production permits, come with documentation and papers required under this Law and its safety technical specifications, and are accompanied by documents such as supervision and inspection reports. At the same time, during use, regular safety inspections and tests must be carried out on special equipment in accordance with the requirements of relevant safety technical specifications, and any issues identified during these inspections or tests must be addressed promptly. II. Regarding the special equipment that has been scrapped. Special equipment should be subject to a retirement system in accordance with the requirements of relevant safety technical specifications; such equipment that exhibits serious defects detected during inspections and cannot be repaired, or that has exceeded its designed service life and cannot continue to be used after a safety assessment, should be retired promptly. For products that have been scrapped, they cannot be used any longer to ensure safety. Otherwise, business entities that sell or lease scrapped special equipment shall be dealt with in accordance with Article 82 of this Law, while entities that use such scrapped special equipment shall be dealt with in accordance with Article 84 of this Law.
