❑ Article 33 of the Special Equipment Safety Law: Units utilizing special equipment shall, before putting such equipment into use or within 30 days after its commissioning, register its use with the department responsible for the safety supervision and management of special equipment, so as to obtain a certificate of use registration. The registration mark shall be placed in a prominent position on such special equipment. 02 Use of special equipment that has passed inspection ❑ Article 32, Paragraph 1 of the Special Equipment Safety Law: Units that use special equipment shall use such equipment that has been manufactured with a license and has passed inspection. ❑ Paragraphs 1 and 3 of Article 40 of the Special Equipment Safety Law: The users of special equipment shall, in accordance with the requirements of safety technical specifications, submit an application for regular inspection to the special equipment inspection agency one month before the expiration of the valid period of the inspection results. Special equipment that has not undergone regular inspections or has failed such inspections shall not be used any longer. 03 Personnel operating special equipment must hold valid certificates to work ❑ Article 14 of the Special Equipment Safety Law: Safety managers, inspectors, and operators of special equipment shall obtain the corresponding qualifications in accordance with **relevant regulations before they can engage in such work. Safety management personnel, inspection personnel, and operators of special equipment shall strictly comply with safety technical specifications and management systems to ensure the safety of such equipment. 04 Improve safety management systems and formulate operating procedures ❑ Article 34 of the Special Equipment Safety Law: Users of special equipment shall establish safety management systems regarding job responsibilities, hazard mitigation, emergency response, etc., and formulate operating procedures to ensure the safe operation of special equipment. 05 Establish a safety management organization, assign safety managers and operators, and organize regular training sessions. ❑ Paragraph 2 of Article 13 of the Special Equipment Safety Law: Entities that produce, operate, or use special equipment shall, in accordance with relevant regulations, appoint safety managers, inspectors, and operators for such equipment, and provide them with the necessary safety education and skill training. ❑ Article 36 of the Special Equipment Safety Law: Operators of special equipment that provides services to the public, such as elevators, passenger cableways, and large-scale amusement facilities, shall be responsible for the safe use of such equipment; they must establish a special equipment safety management organization or appoint full-time personnel in charge of special equipment safety ; Other entities that use special equipment shall, depending on the circumstances, establish a special equipment safety management organization or appoint full-time or part-time special equipment safety managers. 06 Establish a ledger for special equipment, and create safety and technical records for each piece of equipment in accordance with the requirements. ❑ Article 35 of the Special Equipment Safety Law: Users of special equipment shall establish safety and technical records for such equipment. The safety technical documentation shall include the following contents: (1) Relevant technical materials and documents such as the design documents of special equipment, product quality certification, instructions for installation, operation, and maintenance, as well as inspection and testing certificates ; (II) Records of regular inspections and periodic self-inspections for special equipment ; (III) Records of the daily usage status of special equipment ; (IV) Maintenance records for special equipment and its associated instruments and meters ; (5) Records of operational failures and accidents involving special equipment. 07 Conducting regular maintenance on special equipment in use ❑ Article 39 of the Special Equipment Safety Law: The entities that use special equipment shall carry out regular maintenance and periodic self-inspections on such equipment, and keep records of these activities. The users of special equipment shall regularly calibrate and maintain the safety accessories and safety protection devices of such equipment, and keep records thereof. 08 Conducting regular self-inspections on special equipment in use ❑ Article 39, Paragraph 1 of the Special Equipment Safety Law: The users of special equipment shall carry out regular maintenance and periodic self-inspections on such equipment, and keep records of these inspections. 09 Establish a dual-prevention mechanism for hierarchical control of safety risks and identification serta resolution of potential hazards ❑ Article 4 of the Work Safety Law: Production and business operation entities must comply with this law as well as other laws and regulations related to work safety, strengthen work safety management, establish and improve a work safety responsibility system that covers all employees along with relevant rules and regulations for work safety. They should increase investment in funds, resources, technology, and personnel for work safety, improve working conditions, enhance standardization and informatization in work safety, establish a dual-prevention mechanism for hierarchical control of safety risks and identification serta resolution of potential hazards, improve mechanisms for risk prevention and mitigation, raise the level of work safety, and ensure safe production. 10 Eliminating potential hazards associated with special equipment ❑ Article 42 of the Special Equipment Safety Law: When special equipment malfunctions or exhibits abnormal behavior, the entity using such equipment must conduct a thorough inspection to eliminate any potential hazards before it can continue to be used. 11 Formulate special emergency plans for accidents involving special equipment and conduct regular drills thereof. ❑ Article 69, Paragraph 3 of the Special Equipment Safety Law: Users of special equipment shall formulate special emergency plans for accidents involving such equipment and carry out regular emergency drills. Units that, in accordance with the \"Rules for the Use and Management of Special Equipment (TSG 08-2017)\\", establish safety management organizations for special equipment and assign full-time safety officers, shall formulate specific emergency plans for accidents involving such equipment, conduct drills at least once a year, and keep records of these drills ; Other user units can include provisions for emergency response to special equipment accidents in their comprehensive emergency plans, conduct emergency drills for such accidents at appropriate times, and keep records of them. 12 After an accident occurs, measures should be taken to organize rescue efforts and report the incident promptly. ❑ Article 70, Paragraph 1 of the Special Equipment Safety Law: After a special equipment accident occurs, the entity responsible for the accident must take actions in accordance with the emergency plan, organize rescue efforts to prevent the accident from spreading, reduce casualties and property losses, protect the accident scene and relevant evidence, and promptly report to the department responsible for supervising special equipment safety at the county-level or higher government, as well as other relevant departments. In addition to fulfilling the aforementioned primary responsibilities, the users of special equipment must also implement relevant laws, regulations, safety technical specifications, and related standards to ensure the safe operation of such equipment.
