What are the rights, obligations, and legal responsibilities of employees in the process of safe production? I. Legal provisions regarding the rights of workers (mainly eight items) 1. Right to information: That is, the right to know about the hazard factors in their workplace and job positions, as well as the preventive measures and emergency response procedures in case of accidents. 2. Right to make suggestions: That is, the right to put forward suggestions regarding the unit’s work safety management. Article 45 of the Work Safety Law of the People’s Republic of China: Employees of production and business operations entities have the right to know about the hazard factors present in their workplaces and job positions, as well as the preventive measures and emergency response procedures for accidents. They also have the right to submit suggestions regarding the work safety practices of their respective entities. Article 32 of the Regulations on Safety Management in Construction Projects: Construction units shall provide workers with safety protection equipment and protective clothing, and inform them in writing of the operating procedures for hazardous positions as well as the risks associated with improper operations. 3. Right to criticize and right to report and file complaints: That is, the right to raise criticisms, make reports, and file complaints regarding the problems existing in the unit’s work in safety production management. 4. Right to refuse: That is, the right to refuse orders to carry out work in violation of regulations or to engage in risky operations. Article 46 of the Work Safety Law of the People’s Republic of China: Employees have the right to raise criticisms, make reports, and file complaints regarding the problems existing in their employer’s work safety practices ; One has the right to refuse unlawful orders and forced participation in risky operations. Production and business operation entities shall not reduce the wages, benefits, or other entitlements of their employees, nor terminate the labor contracts with them, merely because the employees have criticized, reported, or filed complaints regarding the entity’s work safety practices, or have refused to follow illegal instructions or engage in dangerous operations. 5. Right to emergency avoidance: That is, when an emergency situation that poses a direct threat to personal safety is detected, one has the right to stop working or to leave the workplace after taking possible emergency measures. Article 47 of the Work Safety Law of the People’s Republic of China: When employees discover an emergency that poses an immediate threat to their personal safety, they have the right to stop working or evacuate the workplace after taking possible emergency measures. Production and business operations entities shall not reduce the wages, benefits, or other entitlements of their employees, nor terminate the labor contracts with them, merely because those employees ceased work or took emergency evacuation measures in such urgent situations. 6. Right to work-related injury insurance: The right to have work-related injury insurance arranged by the employer for them. Article 44 of the Work Safety Law of the People’s Republic of China: The labor contracts concluded between production and business operations entities and their employees shall specify matters related to ensuring the safety of those employees at work and preventing occupational hazards, as well as matters concerning the provision of work-related injury social insurance for them in accordance with the law. Production and business operation entities shall not enter into any agreement with their employees in any form to exempt or reduce their legal liability for injuries or deaths of employees resulting from production safety accidents. Article 38 of the Regulations on Safety Management in Construction Projects: Construction units shall arrange for accident insurance for personnel carrying out hazardous tasks at the construction site. 7. Right to claim compensation: In the event of damage resulting from a production safety accident, the right exists to submit a claim for compensation to one’s own employer. Article 48 of the Work Safety Law of the People’s Republic of China: Employees who have suffered harm as a result of work-related accidents shall, in addition to being entitled to work-related injury social insurance in accordance with the law, also have the right to receive compensation in accordance with relevant civil laws; such employees may file claims for compensation with their employer. 8. Right to labor protection: The right to receive labor protection equipment that meets **standards or industry standards. Article 47 of the Building Law of the People’s Republic of China……Workers have the right to propose improvements to work procedures and conditions that affect their health, and they have the right to receive protective equipment necessary for safe work. …… Article 37 of the Work Safety Law of the People’s Republic of China: Production and business operation entities must provide employees with equipment that meets relevant standards, and supervise and educate them on how to wear and use such equipment in accordance with the prescribed rules. II. Legal provisions regarding the obligations of employees (three main ones) 1. Obligation to comply voluntarily: During their work, employees must abide by the company’s safety regulations and operating procedures, submit to management, and properly wear and use personal protective equipment. Article 49 of the Work Safety Law of the People’s Republic of China: During the course of work, employees shall strictly abide by their employer’s work safety rules and regulations as well as operating procedures, comply with management directives, and properly wear and use personal protective equipment. 2. The obligation to voluntarily learn safety production knowledge: Employees are required to master the safety production knowledge necessary for their jobs, improve their skills in safe production, and enhance their ability to prevent accidents and handle emergencies. Article 50 of the Work Safety Law of the People’s Republic of China: Employees shall receive work safety education and training, acquire the work safety knowledge necessary for their jobs, improve their work safety skills, and enhance their ability to prevent accidents and handle emergencies. Articles 30–37 of the Regulations on Work Safety Management in Construction Projects stipulate that before taking up a new position or working at a new construction site, workers must receive training on work safety. Persons who have not received training or failed the training assessment shall not be allowed to work. 3. Obligation to report hazards: When employees discover potential accident risks or other safety hazards, they must immediately report them to the on-site safety management personnel or the person in charge of the organization. Article 51 of the Work Safety Law of the People’s Republic of China: Employees who discover potential accident hazards or other unsafe factors shall immediately report them to the on-site work safety management personnel or the person in charge of the unit ; The person who receives the report should handle it promptly. III. Legal Responsibilities of Employees 1. Article 90 of the Work Safety Law of the People’s Republic of China stipulates that if company employees fail to comply with management requirements or violate work safety regulations or operating procedures, the company shall give them criticism and education, and impose sanctions in accordance with relevant regulations ; If a major accident occurs and it constitutes a crime, criminal liability shall be pursued in accordance with the relevant provisions of the Criminal Law. 2. Article 58 of the Regulations on Safety Management in Construction Projects: If registered professionals fail to comply with laws, regulations, and mandatory standards for construction projects, they shall be ordered to suspend their practice for not less than 3 months but not more than 1 year ; In serious cases, the professional qualification certificate shall be revoked, and registration shall not be permitted for 5 years ; Those responsible for major safety accidents shall not be registered for life ; If a crime is constituted, criminal liability shall be pursued in accordance with the relevant provisions of the Criminal Law.
