Article 1 These Provisions are formulated in accordance with laws and regulations such as the Work Safety Law of the People’s Republic of China and the Regulations on Work Safety of Shandong Province, with the aim of strengthening the safety management of hazardous operations in enterprises, preventing and reducing work-related accidents, and safeguarding the lives of workers. Article 2 This Measures shall apply to the reporting and management procedures for hazardous operations carried out by enterprises within the administrative region of this province, including blasting, lifting, hoisting, excavation, hot work, temporary electrical use, trial production of hazardous equipment and devices, work in confined spaces, operations involving toxic or harmful substances, demolition of buildings and structures, as well as operations conducted near oil and gas pipelines, high-voltage power transmission lines, etc. Where laws, regulations, rules, and standards provide alternative provisions regarding the management of reports on hazardous operations carried out by enterprises, such provisions shall apply. Article 3: Enterprises shall bear primary responsibility for the safety management of hazardous operations within their own organizations. Article 4: Enterprises shall, in accordance with the law, formulate management regulations regarding hazardous operations within their organizations, specifying provisions related to permit approval, qualification verification, on-site management, and operation reporting. Article 5: Enterprises shall, by January 31 of each year, report to the department responsible for work safety supervision and management in their locality information such as the types of hazardous operations carried out, the duration of these operations, and the main locations where they take place. The deadline for submitting the 2022 Hazardous Operations Information Report is August 1, 2022. Any increase or decrease in the types of hazardous operations must be reported within 15 days. Article 6: Before carrying out hazardous operations, enterprises shall conduct a comprehensive assessment taking into account factors such as the type of hazardous operation, the working environment, the number of workers involved, as well as the possible types of accidents and their consequences. They shall formulate operation plans and emergency measures in accordance with the law, go through the approval procedures for such operations, provide safety and technical instructions to the workers, and make preparations for emergency responses at the work site. Article 7 When carrying out hazardous operations, enterprises shall take the following measures to strengthen safety management at the sites of such operations: (1) Identify safety risks at the operation site ； (II) Designate a specific person to provide unified command over the operational activities ； (3) Designate safety production personnel to conduct on-site inspections of the work plan, emergency measures, work permits, etc., to ensure that the qualifications, physical condition of workers, and the protective equipment they wear all meet the requirements for safe operations ； (4) Equip with safety protection devices and emergency rescue equipment as required, and set up safety warning signs ； (5) Other measures stipulated by laws, regulations, rules, and standards. Article 8 Enterprises shall, in accordance with the law, strengthen the safety management of hazardous operations carried out by units such as contractors and lessees, as well as by external construction teams, and shall assume the obligation to report such hazardous operations. Enterprises should exercise unified coordination and management over the work related to safe production in the collaborative units that are located within their production and operation areas, clarify the risks associated with production activities as well as the requirements for safety management, and urge such units to establish and implement proper safety regulations and measures. Article 9: Enterprises shall establish archives for hazardous operations, and document materials such as hazardous operation plans and emergency measures in written form, diagrams, audio, or video for future reference. Article 10 The management of reports on hazardous operations shall adhere to the principle of combining local supervision with hierarchical supervision, with local supervision being the primary approach. Article 11 Departments at all levels responsible for work safety supervision and management shall, in accordance with laws, regulations, rules, standards, and the provisions of these measures, urge enterprises to report information on hazardous operations in a timely and truthful manner. Article 12: Departments at all levels responsible for safety production supervision and management shall employ information technology tools to aggregate, analyze, and evaluate the information on hazardous operations reported by enterprises, thereby providing support for improving the efficiency of safety production supervision and enforcement. Article 13 Departments at all levels responsible for work safety supervision and management shall include the implementation of arrangements regarding hazardous operations by enterprises in their law enforcement inspection plans. They shall regard operation plans, emergency measures, and work permits as key elements of supervision and law enforcement, and investigate and punish any illegal or non-compliant acts related to hazardous operations in accordance with the law. Article 14: If an enterprise fails to submit reports on hazardous operations in accordance with the provisions of these measures, the relevant departments responsible for work safety supervision and management shall subject it to enhanced supervision. Article 15: Employees of enterprises and the general public are encouraged to report any potential hazards in hazardous operations, as well as any illegal or irregular acts. Those whose reports are verified to be true shall be rewarded in accordance with relevant regulations. Article 16: Each municipality may, in accordance with these Measures and local realities, formulate specific implementation measures. Article 17 These measures shall come into force as of June 1, 2022, and remain valid until May 31, 2027.
