Regulations of Jiangsu Province on Work Safety (adopted at the 24th meeting of the Standing Committee of the 12th People’s Congress of Jiangsu Province on July 29, 2016; revised at the 2nd meeting of the Standing Committee of the 14th People’s Congress of Jiangsu Province on March 30, 2023) Table of Contents Chapter I General Provisions Chapter II Guarantees for Work Safety in Production and Business Operations Chapter III Supervision and Management of Work Safety Chapter IV Emergency Rescue, Investigation, and Handling of Work Safety Accidents Chapter V Legal Responsibilities Chapter VI Supplementary Provisions Chapter I General Provisions Article 1 These Regulations are formulated in order to strengthen work safety efforts, prevent and reduce work safety accidents, protect the lives and property of the people, and promote high-quality economic and social development, in accordance with laws and administrative regulations such as the Work Safety Law of the People’s Republic of China, and taking into account the actual conditions of this province. Article 2 These Regulations shall apply to the work safety and related supervision and management of entities engaged in production and business operations within the administrative territory of this province (hereinafter collectively referred to as production and business operation entities). Where relevant laws and regulations provide separate provisions regarding fire safety, road traffic safety, railway traffic safety, water traffic safety, civil aviation safety, as well as nuclear and radiation safety and the safety of special equipment, such provisions shall apply. Article 3: Work related to work safety shall adhere to the leadership of the Communist Party of China. Work related to work safety must be people-oriented, adhering to the principle of putting the people and their lives first. Protecting people’s lives and safety should be given top priority. It is necessary to foster a sound concept of safe development, uphold the principles of “safety first, prevention foremost, and comprehensive management,” prevent and defuse major safety risks at the source, and enhance the intrinsic level of safety. In terms of work safety, it is essential to ensure safety wherever there is industry management, business operations, or production and business activities. The primary responsibilities of production and business entities, as well as those of regulatory authorities, must be strengthened and implemented. Local management responsibilities should also be enhanced, and a mechanism should be established that involves responsibility on the part of production and business entities, participation by employees, supervision by regulatory authorities, industry self-discipline, and social oversight. Article 4: Production and business operation entities are the main responsible parties for work safety. The principal person in charge of a production and business operation entity is the primary responsible person for work safety within the entity, and bears overall responsibility for such work. Other persons in charge shall fulfill their work safety responsibilities within the scope of their respective duties. The key persons in charge of a production and operation entity include the legal representative, the actual controller, as well as other individuals who hold the highest management and decision-making powers regarding the entity’s production and operations. Employees of production and business entities have the right to receive safety guarantees in accordance with the law, as well as the obligation to fulfill their duties related to work safety. Article 5 People’s governments at the county level and above shall strengthen leadership over work related to work safety, and formulate and implement work safety plans in accordance with national economic and social development plans ; Strengthen the development of infrastructure for work safety and the capacity for work safety supervision, establish and improve the work safety governance system, and set up comprehensive mechanisms for preventing and controlling safety risks ; Implement systems for assessing responsibility in work safety and holding those responsible for production safety accidents accountable, and strengthen supervision and inspection of the implementation of work safety measures by relevant departments and lower-level people’s governments. Townships and towns, sub-district offices, development zones, industrial parks, port areas, scenic areas, etc., shall, in accordance with their responsibilities, conduct supervision and inspections on the safety production conditions of production and business entities within their respective areas, and assist the relevant higher-level departments or carry out safety production supervision and management duties in accordance with the law as authorized. Article 6: The work safety committees of local people’s governments at the county level and above are responsible for studying and formulating plans, as well as coordinating work safety efforts in their respective areas. They formulate policies and measures related to work safety, regularly analyze the work safety situation, and promptly address any major issues that arise in the supervision and management of work safety. The office of the Work Safety Committee is located in the emergency management department at the same level, and is responsible for the daily operations of the Work Safety Committee. The Work Safety Committee may establish specialized work safety committees based on the characteristics of key industries and sectors in the region, to be responsible for guiding and coordinating work safety efforts in those industries and sectors. Article 7 The emergency management departments of local people’s governments at or above the county level shall, in accordance with the law, exercise comprehensive supervision and management over work related to work safety within their respective administrative regions. The competent departments in various industries and fields such as emergency management, education, industry and information technology, public security, ecological environment, housing and urban-rural development, transportation, water resources, agriculture and rural affairs, culture and tourism, market supervision, grain and food reserves, civil air defense, railways, communications, and postal services carry out supervision and management of work related to work safety within their respective mandates, in accordance with the law. The competent departments in other sectors and fields such as provincial development and reform, science and technology, civil affairs, human resources and social security, natural resources, commerce, health, and state-owned assets shall, within their respective mandates, strengthen work related to work safety through aspects such as industry planning, industrial policies, regulations and standards, and administrative approvals, and fulfill their responsibilities for managing work safety in those respective sectors and fields. Other relevant departments such as those in charge of finance, judicial administration, and radio and television provide support and guarantees for work related to safe production within their respective areas of responsibility, working together to promote safe development. The people’s governments of cities divided into districts and counties (cities, districts) shall, in light of local conditions, designate the departments responsible for supervising and managing work safety in relevant industries and fields, as well as other departments that are tasked with carrying out work safety management and assurance duties. Where the responsibilities for safety production supervision and management in emerging industries and fields are not clear, local people’s governments at the county level or above shall designate the supervisory departments in accordance with the principle of similar functions. The emergency management departments and those responsible for supervising and managing work safety in relevant industries and fields are collectively referred to as departments with responsibilities for work safety supervision and management. Local people’s governments at the county level and above shall organize the formulation of lists outlining the responsibilities and tasks of relevant departments regarding work safety, and include the fulfillment of these safety-related responsibilities as part of the annual comprehensive assessments. Article 8 The principal responsible persons of people’s ** governments at all local levels and the relevant departments bear overall leadership responsibility for work related to work safety in their respective regions and sectors under their jurisdiction ; The person in charge of work safety bears overall leadership responsibility for the supervision of work safety efforts ; Other responsible persons bear direct leadership responsibility for work safety within their respective areas of responsibility. Local people’s governments at all levels shall draw up annual lists of key tasks related to work safety for the principal responsible persons, persons in charge of work safety, and other relevant officials; they shall include the fulfillment of work safety responsibilities as part of their annual performance reports, and regularly organize work safety education and training. Article 9 Trade unions shall supervise work safety in accordance with the law, participate in investigations into work safety accidents, put forward suggestions to ensure work safety, and safeguard the legitimate rights and interests of workers in regard to work safety. The trade union of the production and operation entity shall, in accordance with the law, organize employees to participate in the **management** and **supervision** of safety production work within the entity. When the production and operation entity formulates or amends safety production regulations or makes decisions related to safety production, it shall take the opinions of the trade union into account. In production and business units where no trade unions have been established, representatives of employees and other workers participate in the **management** and **supervision** of safety production work within such units. Article 10 The provincial standardization administrative department, in conjunction with relevant provincial departments, shall formulate relevant local standards in a timely manner in accordance with the law and in line with the requirements for ensuring safe production. Social organizations and production and business entities are encouraged to formulate or implement organizational standards and corporate standards for ensuring work safety that are higher than **national standards, industry standards, and local standards. Article 11 People’s **s at all local levels, relevant departments, and production and operation units shall strengthen the construction of safety culture, carry out publicity on laws, regulations regarding work safety as well as knowledge related to work safety, provide education on work safety hazards, organize mass-based safety culture activities, and enhance the awareness of work safety throughout society. Cities divided into districts shall establish practical bases for work safety education in order to innovate the forms of such education. Departments such as those in charge of education and human resources and social security should incorporate the dissemination of safety production knowledge into national education, establish and improve systems for safety education in schools and occupational safety training in high-risk industries, and include safety production in relevant skill assessments and employment training programs. Local administrative colleges should include safety production education and training in their teaching plans. Encourage and support colleges, universities, and secondary vocational schools to strengthen research in science and technology related to work safety, establish majors or training programs in work safety management, and cultivate professionals in this field. Various media outlets such as radio, television, newspapers, and websites should carry out public welfare campaigns on work safety, report on work safety situations in a timely manner, and strengthen public oversight of work safety efforts as well as illegal acts related to work safety. Article 12: The provincial emergency management department, in conjunction with relevant departments, shall establish a cooperation mechanism for work related to work safety with the relevant departments in the Yangtze River Delta region. It shall coordinate major issues related to work safety within the region, build a work safety management system characterized by information sharing, resource sharing, and coordinated operations. Efforts shall be made to strengthen the integration of emergency rescue systems, improve joint prevention and control of major safety risks, ensure coordination among emergency rescue plans, and carry out cross-regional enforcement actions related to work safety. Article 13 Units and individuals that have made significant achievements in improving safety production conditions, preventing or reducing work-related accidents, participating in emergency rescue efforts, and researching and promoting scientific and technological methods as well as advanced management practices for safety production shall be commended and rewarded in accordance with the relevant regulations of ** and the province. Chapter 2: Safety Assurance in Production and Business Operations Article 14: Production and business operations entities shall establish and improve a comprehensive safety responsibility system for all employees. It is necessary to clarify the responsibilities and assessment criteria for key personnel, other supervisors, heads of functional departments, managers of production workshops (teams), team leaders, as well as all employees working at various positions. Supervision, assessment, and rewards or penalties should be implemented to ensure that this safety responsibility system is properly carried out by everyone. The safety production responsibility system for all employees and the assessment results are made public to all workers. Production and operation units shall establish safety production regulations and systems covering investment guarantees for safety production, publicity, education, and training, hierarchical control of safety risks, identification and rectification of potential accident hazards, emergency rescue, management of hazardous operations, change management, and contracting (leasing) management. Where there are major hazard sources with a high level of safety risk, important facilities and equipment, or key production and operation sites, special management systems shall also be developed. Smaller production and business units, such as small and micro enterprises, may formulate comprehensive safety production regulations that include the provisions mentioned in the preceding paragraph, tailored to the characteristics of their own production and operations. Article 15: In addition to fulfilling the safety production responsibilities stipulated in the Work Safety Law of the People’s Republic of China, the principal responsible persons of production and business operations shall also carry out the following duties: (1) Organize and participate in at least one comprehensive safety production inspection per quarter, and study, analyze, and resolve any issues related to safety production ; (II) Organize and participate in at least one emergency rescue drill for production safety accidents each year ; (III) Conduct at least one comprehensive safety risk assessment each year, and formulate and improve control measures ; (IV) In the event of a production safety accident, promptly organize rescue efforts, report the details of the accident to the departments responsible for safety supervision and management in a timely and truthful manner as required, handle the subsequent matters properly, and cooperate with any investigations ; (5) Every year, reports on work related to safety production as well as on the fulfillment of individual responsibilities in this area shall be submitted to the employees through staff meetings or employee representative assemblies, information display boards, etc., so as to allow them to exercise supervision. Article 16 Mining enterprises, metal smelting facilities, construction companies, ship repair and building yards, ship dismantling facilities, transportation entities, as well as entities engaged in the production, operation, storage, and handling of hazardous materials shall establish work safety management organizations and appoint full-time work safety managers in accordance with the following provisions: (1) For enterprises with fewer than 30 employees, at least one full-time work safety manager must be appointed ; (II) For enterprises with 30 or more but less than 100 employees, a dedicated safety production management department shall be established, along with at least two full-time safety production managers ; (III) For enterprises with 100 to less than 300 employees, a dedicated safety production management organization shall be established, along with at least three full-time safety production managers ; (IV) For enterprises with 300 or more employees, a dedicated safety production management organization shall be established, and full-time safety production managers shall be assigned at a ratio of not less than 1 percent of the total number of employees. For other production and business entities that are not covered by the provisions of the preceding paragraph, if they have more than 100 employees, they shall establish a safety production management organization or appoint full-time safety production managers ; For enterprises with 100 or fewer employees, full-time or part-time safety management personnel must be assigned. Production and operation units with 20 or fewer employees that are located in close proximity to each other, operate in similar industries, and engage in similar types of business can carry out safety management activities by forming mutual assistance associations for safety management or by entrusting relevant organizations to provide such services; however, the responsibility for ensuring safety remains with the respective units themselves. Where a production or business entity employs dispatched workers, the number of such workers is included in the total number of employees of the entity. **Where there are separate provisions for labor-intensive industries such as construction regarding the establishment of safety production management institutions or the assignment of full-time safety production managers, those provisions shall be followed. Article 17 In addition to fulfilling the safety production responsibilities stipulated in the Work Safety Law of the People’s Republic of China, the safety production management departments and safety production managers of production and business operations entities shall also carry out the following duties: (1) Organize and participate in at least one comprehensive safety production inspection per month ; Organize or participate in the identification and assessment of safety risks, and urge various departments and positions to implement hierarchical control measures ; (II) Urge various departments and positions to fulfill their responsibilities regarding work safety, organize or participate in the assessment of the overall work safety responsibility system, and put forward suggestions regarding rewards and penalties ; (III) Conduct supervision and inspection of the safety production qualifications and conditions of the contracting and leasing units that operate within the premises of this unit ; (IV) Supervise the procurement, distribution, use, and management of labor protection equipment. Article 18: Units that produce, store, or handle hazardous materials, as well as mining and metal smelting enterprises, shall appoint registered safety engineers with relevant expertise to be responsible for work safety management in accordance with **relevant regulations. Article 19: Mines, metal smelting, construction, shipbuilding, ship dismantling, road transportation, and entities engaged in the production, operation, storage, and handling of hazardous materials that employ 100 or more workers, as well as those in industries and sectors involving explosive dusts or ammonia-based refrigeration, shall appoint a safety director or another full-time person in charge of safety to assist the principal responsible person in fulfilling safety-related duties. Other industries and sectors are encouraged to appoint safety directors or other full-time officials responsible for work safety. The safety director or another person specifically responsible for work safety should hold a technical title at the engineer level or above in a relevant field, or possess the qualification of a registered safety engineer in such a field, and should be familiar with the laws, regulations, standards, and guidelines related to work safety. Article 20: The decision-making body, principal responsible person of a production and operation entity, or the investor in a individually operated business shall ensure the provision of funds necessary for meeting safety production requirements, and include such funds in the annual production and operation plan as well as the financial budget. These funds should be primarily used for aspects such as safety risk management and control, elimination of potential accident hazards, maintenance of safety facilities and equipment, safety production education and training, provision of personal protective equipment, emergency rescue drills, and the acquisition of necessary equipment and supplies. Relevant production and business entities shall **withdraw and use safety production funds as stipulated, which shall be used exclusively for ensuring and improving safety production conditions. Capital investments for safe production, such as funds for safe production expenses, are included in the costs of production and business operations. Article 21 Production and business operation entities shall, in accordance with the law, provide education and training on safety operating procedures and safety operating skills to the following personnel prior to their taking up duties, and keep records as well as conduct assessments ; Those who have not undergone safety production education and training and passed the assessments shall not be allowed to work: (1) Newly hired employees ; (II) Employees who have been away from their post for more than six months or have changed positions ; (III) Workers involved in the use of new processes, technologies, materials, or new equipment. Production and operation units may organize training on their own, or they may entrust institutions that meet the requirements for safety production training to carry out such training. If a production or business entity entrusts someone to conduct training, it shall supervise the training process to ensure its quality. Workers shall, as required, undergo work safety education and training, acquire the work safety knowledge necessary for their duties, improve their safety operation skills, and enhance their ability to prevent accidents and handle emergencies. Article 22: The principal persons in charge and work safety management personnel of mines, metal smelting enterprises, construction firms, ship repair and building facilities, ship dismantling facilities, transportation entities, as well as entities engaged in the production, operation, storage, and handling of hazardous materials must pass an assessment conducted by the competent department responsible for work safety supervision and management, regarding their knowledge of work safety and their management capabilities. The principal persons in charge and safety production management personnel of the production and business operation entities referred to in the preceding paragraph shall, if newly appointed, pass the assessment on safety production knowledge and management capabilities within six months as of the date of taking up their positions ; Those who have passed the assessment should receive retraining on safety production knowledge in accordance with relevant regulations ; In the event of a production safety accident that results in deaths, the person must retake the safety production knowledge training and pass the assessment. Special operation personnel in production and business units shall receive specialized safety training in accordance with **relevant regulations; only after passing the assessment and obtaining the corresponding qualifications may they take up their posts. Article 23: Mines, metal smelting facilities, construction sites, shipbuilding and repair yards, ship dismantling plants, as well as entities engaged in the production, operation, storage, and handling of hazardous materials, as well as those in industries and sectors involving explosive dusts or ammonia-based refrigeration, shall establish and implement a pre-shift safety meeting system. At these meetings, the shift leader or the person handing over duties shall inform the workers on duty about potential safety risks and explain the key safety procedures for their specific tasks. Article 24: Before starting work each day, employees of production and business units shall conduct safety inspections for their respective positions, and only after confirming that everything is safe may they proceed with their tasks. Safety inspections for work positions mainly include the following items: (1) The facilities, equipment, tools, and raw materials are in good safety condition, and the safety protection devices are effective ; (II) The work area and the storage of items comply with safety standards ; (III) Personal protective equipment and tools are complete and in good condition, and are worn and used correctly. Article 25: Production and business entities shall strengthen the standardization of work safety, establish and improve a work safety management system, comprehensively control safety risks at all stages of production and business activities, promote the systematic nature of safety management, standardize operational procedures at each post, enhance the inherent safety of facilities and equipment, and ensure that tools and equipment in the working environment are properly arranged, thereby improving the overall level of work safety management. The departments responsible for supervising and managing work safety shall encourage production and business entities to carry out work safety standardization. Relevant departments and agencies provide incentives such as recognition for excellence and financial and insurance support to production and business units that carry out work on standardizing safety production, in accordance with relevant regulations. Article 26: Production and business operation entities shall implement a system for hierarchical control of safety risks. They shall regularly organize relevant personnel in charge of safety management, engineering technology, and operational procedures within the entity to conduct a comprehensive and systematic identification and assessment of safety risks existing in aspects such as production processes, facilities and equipment, working environments, employee behavior, and management systems. By determining the level of these safety risks, they shall formulate control measures in terms of organization, technology, management, and emergency response, prepare a list of safety risk control measures, and carry out hierarchical control in accordance with the identified risk levels. Production and operation units shall develop specific control plans for major safety risks existing, and strengthen control by taking targeted measures such as isolating the sources of safety risks, employing technical solutions, providing individual protective equipment, and installing monitoring and early-warning devices. Article 27: Production and business operation entities shall establish and improve monitoring systems for major hazard sources, connect such systems to the monitoring equipment of departments responsible for work safety supervision and management, and carry out regular maintenance to ensure the proper operation of the systems. Article 28: Production and business operation entities shall implement a system for identifying and addressing potential accident hazards, regularly organizing safety management, engineering technology, and other relevant personnel to identify such hazards and promptly eliminate them within the entity. During the process of addressing potential accident hazards, appropriate safety precautions should be taken to prevent accidents from occurring. For the major accident hazards identified, the production and operation units shall formulate and implement remediation plans to eliminate them promptly, and suspend the use of relevant facilities and equipment or cease operations as necessary. The progress in identifying and addressing major accident hazards shall be reported to the departments responsible for work safety supervision and management, as well as to the workers’ assembly or workers’ representative congress. Production and operation entities shall establish a system for rewarding reports of potential accident hazards, make public the contact information of their relevant responsible persons and safety production management agencies, accept reports of safety production issues from employees, and commend and reward those employees who report potential accident hazards. Article 29: When engaging in hazardous operations such as blasting, lifting, work at heights, work in confined (restricted) spaces, work near oil and gas pipelines, work near high-voltage power lines, demolition of buildings and structures, major maintenance tasks, as well as welding or using temporary electricity in areas involving dangerous materials, production and operation units shall implement relevant management systems for hazardous operations and comply with the following provisions: (1) Assess the safety risks associated with the operations to ensure that the on-site conditions meet the requirements for safe conduct of such operations ; (II) Determine safety prevention measures and on-site emergency response measures based on safety risks ; (III) Verify that the operators meet the required qualifications for working, and that the personal protective equipment provided is used in accordance with safety requirements ; (IV) Equip appropriate safety facilities and emergency rescue equipment, designate safe areas at the work site, and assign dedicated personnel to provide unified command and supervision on-site ; (5) Before carrying out hazardous operations, inform the workers of the risk factors, safety requirements for the operations, and on-site emergency response measures, and have both parties sign to confirm this in person ; (6) In the event of an emergency that poses a direct threat to personal safety, operations shall be halted and personnel evacuated in accordance with the on-site emergency response procedures. Where a production or business operation entity entrusts another entity to carry out hazardous operations, it shall enter into a work safety management agreement with the entrusted party prior to the commencement of such operations, so as to clarify and implement the provisions of the preceding paragraph; it shall exercise unified coordination and management over the work safety efforts of the entrusted party, and strengthen supervision and inspection. Production and business operation entities shall not delegate hazardous operations to entities or individuals that do not possess the necessary safety production conditions or appropriate qualifications. Article 30 Where a production and operation entity subcontracts or leases out its production and operation projects, premises, or equipment, it shall fulfill the following safety production responsibilities: (1) Enter into a separate safety production management agreement, or specify respective safety production responsibilities in the contract or lease agreement ; (II) Provide the contractor or tenant in writing with information on the basic details of the project assigned or the premises leased, as well as the relevant equipment, along with the requirements regarding safe production ; (III) Coordinate and resolve safety production issues raised by the contractor and lessee ; (IV) Conduct safety production inspections on contractors and lessees, record the inspection findings accurately, and promptly urge rectification in case of any safety production issues identified ; If any violations related to work safety are discovered, they should be reported promptly to the department responsible for supervising and managing work safety. The contractor and lessee shall comply with the unified coordination and management by the employer and lessor regarding their work safety, and shall be legally responsible for the work safety of their own units ; In the event of a production safety accident, it is necessary to report it promptly to the local emergency management department and relevant authorities in accordance with relevant regulations, and to inform the contract issuer and lessor as well. Article 31: Production and business operation entities shall bring dispatched workers and flexible workforce members who receive instructions from them under their unified management system for ensuring work safety among all employees, and shall fulfill their responsibilities regarding work safety protection; they shall not shift such responsibilities to labor dispatch agencies or to the dispatched workers and flexible workforce members themselves. Production and business units are encouraged to provide safeguards such as insurance coverage for workers on flexible contracts. The labor dispatch agency shall provide the dispatched workers with necessary safety production education and training. Article 32: Production and business operations entities shall provide their employees with labor protection equipment that meets **standards or industry standards, and shall educate and urge them to wear and use such equipment correctly. Production and business operations entities shall not replace the provision of personal protective equipment with the issuance of currency or other items. Production and business entities shall strengthen labor protection for female employees, minor workers, etc. in accordance with the law. Article 33: Production and business operations entities shall pay attention to the physical, psychological conditions and behavioral habits of their employees, strengthen health checks, psychological counseling, and emotional support for them, in order to prevent production safety accidents caused by abnormal behavior among employees. Article 34: Business operators of establishments such as hotels, restaurants, shopping malls, marketplaces, passenger stations, ferry terminals, civil airports, sports venues, public entertainment venues, and tourist attractions shall use buildings in a safe manner in accordance with **relevant regulations. If, during the use of a building, it is necessary to change its intended use, increase the load on it significantly, add more floors, or alter the building’s main structural elements, which could affect its safety, then the owner of the building or the entity responsible for its operation must, prior to commencement of construction, engage a design firm with the appropriate qualifications to provide an opinion, or conduct a safety assessment of the building in accordance with relevant regulations. If the organizers of large-scale public events need to construct temporary buildings, structures, as well as facilities and equipment, they must conduct inspections and tests on their safety to ensure the safety of such buildings, structures, facilities, and equipment. Article 35: Institutions such as schools, research institutes, and medical and health facilities that use hazardous materials shall establish and improve safety management systems for such materials, conduct safety risk assessments, implement measures to control those risks, and enforce strict regulations on the use of hazardous materials. Article 36: Production and business operation entities shall accelerate the adoption of new processes, technologies, materials, and equipment that help improve safety conditions in production, promptly update and renovate facilities and equipment that have exceeded their service life, and phase out those processes and equipment that pose a threat to production safety as designated by the state and provincial authorities. Units that produce and store hazardous materials, as well as those engaged in mining, metal smelting, construction, passenger transport, and heavy freight transportation, should utilize modern scientific and technological methods to achieve intelligent control of the production process and monitoring and early warning of safety risks, thereby improving the level of intrinsic safety. Article 37: Units that produce and store hazardous materials, as well as those engaged in mining, metal smelting, construction, and industries and sectors involving explosive dusts or ammonia-based refrigeration, shall strengthen the informational management of work safety. They should utilize digital technologies to carry out safety risk control, identify and address potential accident hazards, and monitor major hazard sources. Article 38: Production and business operation entities in high-risk industries and fields shall purchase work safety liability insurance in accordance with relevant regulations. Other production and business entities are encouraged to purchase work safety liability insurance. The specific implementation measures shall be formulated by the provincial emergency management department in conjunction with relevant departments in accordance with **provisions. Article 39: Safety assessments, certifications, tests, and inspections that are required by law to be carried out shall be undertaken by safety production technology service institutions that meet the **specified qualification requirements. Safety production technology service agencies shall carry out their professional activities in accordance with relevant standards and regulations, establish and implement systems for making their services and reports public, and the results of safety assessments, certifications, tests, and inspections they conduct must be objective and accurate. Article 40: Relevant association organizations shall strengthen industry self-discipline in accordance with laws, regulations, and their own charters; they shall cooperate in the identification, assessment, and monitoring of safety risks in related industries and fields, assist in promoting the standardization of safe production in such industries and fields, provide services such as information, training, and technical consultation related to safe production, conduct research on fundamental safety concepts and technical challenges in safe production as well as promote the dissemination of relevant findings, thereby helping production and business units to improve their safe production practices. Chapter 3 Supervision and Management of Work Safety Article 41 People’s governments at the county level and above shall organize the departments responsible for work safety supervision and management to formulate, in accordance with the law, lists of powers and responsibilities related to work safety, and implement dynamic management thereof. Lists of powers and responsibilities should be made public to the society for social oversight. People’s governments at all local levels **should include work related to safety production among their key priorities**, holding at least one meeting per quarter to review progress in this area, discuss important matters related to safety production, and address any major issues that arise in this field promptly. Article 42 The Office of the Work Safety Committee shall perform the following duties related to work safety: (1) Organize the implementation of the decisions and arrangements regarding work safety issued by the people’s government at the corresponding level, conduct regular analyses and assessments of the work safety situation, and put forward suggestions regarding major policies and measures for work safety ; (II) Guide, coordinate, supervise, and inspect the work related to work safety in the relevant departments of the people’s government at the same level as well as in the people’s governments at lower levels; organize joint inspections, special rectification efforts, and special audits regarding work safety ; (III) Organize and carry out inspections and evaluations of the performance of work related to work safety by the relevant departments at the corresponding level and by the lower-level people’s governments ; (IV) Other duties assigned by laws, regulations, rules, and the people’s ** at this level as well as the work safety committee. Article 43: Departments responsible for work safety supervision and management shall designate the agencies and personnel in charge of such supervision and management, strengthen the development of professional oversight capabilities, fulfill their relevant duties in accordance with the law, and investigate and deal with any violations related to work safety. Article 44: The people’s congresses at the township level and sub-district offices shall establish comprehensive agencies for work safety supervision and management. Development zones, industrial parks, port areas, scenic areas, etc., shall designate agencies responsible for work safety supervision and management as well as define their responsibilities. Townships, sub-district offices, as well as development zones, industrial parks, port areas, scenic areas, etc., should assign qualified professionals to carry out work related to the supervision and management of safety in production, taking into account factors such as the characteristics of the industries present in their respective areas and the number of production and business units there. Local people’s governments at the township level, sub-district offices, as well as agencies responsible for safety production supervision and management in development zones, industrial parks, port areas, scenic areas, etc., shall, upon discovering any violations of safety production regulations or potential accident hazards during their inspections and supervision, handle such issues within their authority or report them or transfer them accordingly in accordance with relevant regulations. The people’s governments of towns and townships, as well as street offices, should include work related to work safety management within the scope of grid-based service management. Article 45 The provincial people’s government may, in light of local conditions, decide in accordance with the law to delegate to the town or township people’s governments and sub-district offices that are capable of handling them effectively those administrative law enforcement matters related to work safety that are urgently needed at the grassroots level, are easy to identify and address, and require appropriate professional expertise, and shall organize regular evaluations. If it is assessed that it is not appropriate for the township people’s congresses or sub-district offices to handle it, the provincial people’s congress shall decide to take it back. Article 46 Village committees and residents’ committees, under the guidance of the people’s governments at the township level and sub-district offices, assist in carrying out work related to safety inspections and handling aftermath of accidents ; If any violations of safety production regulations or potential accident hazards are discovered, they should be reported promptly to the local people’s government or the relevant authorities. Article 47 The emergency management department shall, based on the safety production conditions within its administrative region, taking into account factors such as the number and capabilities of supervision personnel, technical equipment and vehicles, as well as financial resources, formulate an annual safety production supervision and inspection plan, which shall be implemented after being approved by the people’s ** at the corresponding level. Other departments responsible for safety production supervision and management may, based on factors such as the number and conditions of production and business entities in their respective industries and fields, formulate annual safety production inspection plans and carry out their implementation. For production and operation entities involved in multiple industries and fields, the departments responsible for safety production supervision and management should cooperate with each other to carry out joint inspections, thereby avoiding duplicate inspections. Departments responsible for supervision and management of work safety may invite professional technicians and experts, or hire professional technical inspectors, to participate in work safety inspections and supervision, as well as investigations into work safety accidents. Article 48: Emergency management departments shall strengthen the development of comprehensive administrative law enforcement teams for emergency management. They shall standardize law enforcement identifiers and uniform styles in accordance with relevant regulations, provide law enforcement personnel and equipment as well as vehicles that meet the requirements for administrative law enforcement in the field of work safety, and conduct regular training and assessments for these personnel on laws, regulations, and related technical knowledge related to work safety, so as to carry out administrative law enforcement activities in accordance with the law. Article 49 People’s governments at the county level and above shall, in accordance with the requirements for safety risk prevention and control, coordinate regional and spatial planning, determine the locations of enterprises in a scientific and rational manner, and implement unified planning and reasonable layout for the production and storage of hazardous chemicals. The people’s government of a city divided into districts **shall organize the relevant departments to formulate a list of hazardous chemicals that are prohibited, restricted, or subject to control within its administrative region, and make this list public. Article 50: Development zones, industrial parks, port areas, scenic areas, etc. shall promote integrated management of public infrastructure, upstream and downstream industrial chains, industrial clusters, logistics transportation, emergency rescue, etc., within their respective areas, and strengthen the safety management of high-risk functional areas such as those involving hazardous materials, metal smelting, warehousing and logistics, and port terminals, as well as key areas within those zones. Article 51: People’s governments at the county level and above shall promote the development of safe cities, strengthen safeguards for the safe operation of cities, establish urban safety assurance systems, and enhance the inspection and maintenance of high-rise buildings, large-scale complexes, power facilities, amusement facilities, elevators, as well as other critical urban infrastructure such as tunnels and bridges, utility tunnels, rail transit systems, gas supply systems, water supply systems, and drainage systems. They shall also raise the standards for the safety of such infrastructure. Article 52: People’s governments at the county level and above shall establish special funds for work safety, which shall be included in the financial budget at the corresponding level. These funds are to be used for the development of emergency rescue systems, the rectification of major accident hazards that pose a threat to public safety, the provision of equipment and facilities for work safety supervision and management, work safety education and publicity, support for technological innovation, as well as providing rewards for reporting major accident hazards and illegal acts related to work safety. Article 53 The provincial emergency management department shall establish a comprehensive emergency management application platform, and make use of modern information technologies such as big data, the Internet of Things, and artificial intelligence to collect, in accordance with the law, safety production data related to safety risk control by production and business entities, identification and rectification of potential accident hazards, as well as monitoring of major hazard sources. Local people’s governments at the county level and above, along with their relevant departments, shall coordinate the development of information systems for work safety. By utilizing provincial big data sharing and exchange platforms, they can gather basic information on work safety in various industries and sectors, thereby enabling information sharing and interconnection among different departments and improving the digital level of work safety supervision and management. Article 54: Local people’s governments at the county level and above, together with their relevant departments, shall incorporate progress in science and technology for safe production into their science and technology development plans. They shall support scientific and technological projects related to safe production that feature high technical content, strong safety benefits, and wide application prospects, and guide production and business entities to carry out intelligent and digital transformations. Industrial robots and intelligent equipment should be widely used in hazardous processes and stages in order to raise the level of science and technology applied to safe production. Article 55: Departments responsible for supervision and management of work safety shall establish a database of information on work safety violations, and accurately record the work safety violations committed by production and business operations entities and their relevant employees. For entities found responsible for any of the following serious illegal acts, their records shall be entered into the credit record system in accordance with laws, regulations, and relevant documents; furthermore, disciplinary measures for bad faith shall be imposed in accordance with the law: (1) In cases where a work safety accident occurs, if the production and business operation entity and its relevant personnel are held responsible for the accident, especially under serious circumstances ; (II) Refusing to comply with the decision issued by the department responsible for safety production supervision and management to order suspension of production or business operations for rectification, and proceeding with production, operation, or construction without authorization ; (III) Institutions responsible for safety assessment, certification, testing, and inspection, as well as their relevant personnel, who lease out their qualifications, operate under false pretenses, or issue false reports ; (IV) Obtaining administrative permits related to work safety by providing false materials or making false commitments ; (5) Other circumstances stipulated by laws and regulations. Article 56: Departments responsible for supervision and management of work safety shall establish and improve procedures for receiving, verifying, handling, transferring, and responding to reports related to work safety, handle such reports in a timely manner, and protect the legitimate rights and interests as well as personal information of those who file the reports. Those who report major potential accident hazards or expose illegal acts in work safety shall be rewarded in accordance with relevant regulations. Article 57: When departments responsible for supervision and management of work safety discover, during the course of administrative law enforcement, that the work safety violations committed by relevant production and business entities or relevant personnel may constitute crimes, or when they come across clues to other criminal cases related to work safety, they shall transfer such cases to the public security organs, which shall handle them in accordance with the law. When investigating cases, if public security authorities discover violations of safety production regulations that do not constitute a crime, they shall transfer the matter to the departments responsible for supervision and management of safety production, which shall handle it in accordance with the law. Article 58: Where, in the course of performing its duties, the people’s procuratorate discovers that a department responsible for work safety supervision and management exercises its powers illegally or fails to perform its duties in accordance with the law, thereby causing harm to **interests or the public interest, it shall issue a procuratorial suggestion to urge such department to perform its duties in accordance with the law ; If they fail to fulfill their duties, the people’s procuratorate shall file an administrative public interest lawsuit with the people’s court in accordance with the law. Chapter 4 Emergency Rescue, Investigation, and Handling of Production Safety Accidents Article 59 People’s governments at the county level and above shall, in light of the characteristics and potential hazards of production safety accidents that may occur in their respective administrative regions, establish emergency rescue bases or professional emergency rescue teams in key industries and sectors, or rely on qualified production and operation entities to do so, in order to enhance the capacity for emergency rescue and handling as well as to promote the sharing of emergency rescue resources. Mines, metal smelting facilities, construction sites, shipbuilding and repair yards, ship dismantling facilities, urban rail transit operators, as well as entities involved in the production, operation, storage, and transportation of hazardous materials, as well as operators of crowded places such as hotels, shopping malls, entertainment venues, and tourist attractions, shall establish emergency rescue teams in accordance with the law ; Smaller production and business units, such as small and micro enterprises, may not need to establish their own emergency rescue teams, but they should appoint part-time emergency rescue personnel and may enter into emergency rescue agreements with nearby emergency rescue teams. Production and operation units in industrial clusters such as development zones and industrial parks can jointly establish emergency rescue teams. Production and operation units as well as other social forces are encouraged to provide social emergency rescue services. For those **commissioned to carry out emergency rescue operations, support in terms of emergency supplies, road access, and financial assistance shall be provided in accordance with relevant regulations. Article 60 People’s governments at the county level and above shall formulate emergency rescue plans for work safety accidents in their respective administrative regions ; The departments responsible for supervision and management of work safety, in accordance with their respective responsibilities, formulate emergency rescue plans for work safety incidents in their own industries and sectors based on the emergency rescue plans for such incidents established by the people’s government at their corresponding level ; Townships and towns, sub-district offices, as well as development zones, industrial parks, port areas, scenic areas, etc., should formulate corresponding emergency rescue plans for production safety accidents. Emergency rescue plans for production safety accidents shall be made public to the society in accordance with the law. Production and operation units shall formulate emergency rescue plans for production safety accidents specific to their own units, prepare emergency response cards for key positions, and organize training on emergency rescue plans, emergency knowledge, self-rescue and mutual rescue skills, as well as skills for avoiding hazards and escaping. The emergency rescue plan for production safety accidents shall be made available to the employees of the unit. Emergency response plans for various types of work-related accidents at all levels shall be revised in a timely manner in accordance with relevant regulations, be coordinated with one another, and regular drills shall be conducted. Article 61 People’s governments at the county level and above, together with their relevant departments, shall, in light of the characteristics and potential hazards of production safety accidents in their respective administrative regions, adopt a combination of methods such as special reserves and agreed-upon reserves to stockpile necessary emergency rescue equipment and supplies at appropriate levels, and shall update and replenish these resources in a timely manner. Production and operation units shall, in accordance with relevant regulations, equip themselves with necessary emergency rescue equipment, apparatus, and supplies, and carry out regular maintenance to ensure their proper use. Article 62 The emergency management department shall, in conjunction with relevant departments, establish an emergency rescue command system for production safety accidents based on the comprehensive emergency management application platform. By making use of information technologies such as big data and cloud computing, it shall achieve data integration, dynamic updates, and information sharing, thereby ensuring unified and efficient emergency command as well as rapid response to emergencies. Article 63 In the event of a work safety accident, local people’s governments at or above the county level shall, in accordance with relevant regulations, organize an accident investigation team to conduct an investigation into the accident. The departments and units involved in the accident investigation and handling shall cooperate with each other. In the event of a major accident, the provincial people’s **can directly organize an accident investigation team to conduct the investigation, or it can authorize or delegate the provincial emergency management department or other departments responsible for work safety supervision and management to organize such an investigation team. In the event of major or minor accidents, the people’s **government of the city divided into districts or of the county (city, district) shall organize an accident investigation team to conduct an investigation based on the severity of the accident; it may also authorize or delegate the emergency management department at the same level, or another department responsible for supervision and management of work safety, to organize such an investigation team. During the accident investigation, if the accident‑causing entity and the relevant responsible persons are found to be suspected of committing crimes, the accident investigation team shall promptly transfer the relevant evidence to the authorities for handling in accordance with the law. Article 64 The people’s ** responsible for investigating and handling accidents shall, within one year after approving the accident investigation report, organize relevant departments to assess the implementation of measures taken to rectify the accident and prevent similar incidents. The evaluation results should be promptly communicated to the relevant regions and departments, filed with the higher-level people’s government, and made public in accordance with relevant regulations. Article 65: The relevant departments of the local people’s governments at the county level and above shall regularly analyze the occurrences of work safety accidents in their respective industries and fields, and report to the emergency management departments at the same level. The emergency management department shall regularly conduct statistical analysis of production safety accidents that occur within its administrative jurisdiction, in order to provide timely warnings regarding safety risks. Chapter 5 Legal Liability Article 66 For acts that violate the provisions of these regulations, if laws and regulations already provide for penalties, such provisions shall apply. Article 67: Staff members of people’s congresses at all local levels and of departments responsible for work safety supervision and management who abuse their powers, neglect their duties, or engage in malpractice for personal gain in the course of such supervision and management shall be given sanctions in accordance with the law ; If a crime is constituted, criminal liability shall be pursued in accordance with the law. Article 68: If the principal responsible person of a production or business operation entity fails to fulfill the safety production responsibilities stipulated in items 1 to 5 of Article 15 of these regulations, they shall be ordered to make corrections within a specified time limit and shall be fined not less than 10,000 yuan but not more than 50,000 yuan ; If the violation is not corrected within the prescribed time, a fine of not less than 50,000 yuan but not more than 100,000 yuan shall be imposed, and the production or business operation entity shall be ordered to suspend operations for rectification. Article 69: If a production or business operation entity violates the provisions of Paragraphs 1 and 2 of Article 16, as well as Article 18 of these Regulations by failing to establish a safety production management organization or assign safety production management personnel or registered safety engineers as required, it shall be ordered to make corrections within a specified time limit, and shall be fined not less than 10,000 yuan but not more than 100,000 yuan ; If the violation is not corrected within the prescribed time, the entity shall be ordered to suspend operations for rectification, and shall also be fined not less than 100,000 yuan but not more than 200,000 yuan; the persons in charge who are directly responsible as well as other persons directly liable for the violation shall be fined not less than 20,000 yuan but not more than 50,000 yuan. Article 70: If the safety management personnel of a production or business operation entity fail to fulfill their safety responsibilities in violation of Article 17 of these regulations, they shall be ordered to make corrections within a specified time limit, and shall be fined not less than 10,000 yuan but not more than 30,000 yuan ; If a production safety accident occurs, its qualifications related to safe production shall be suspended or revoked, and a fine of not less than 20 percent but not more than 50 percent of its annual income from the previous year shall be imposed. Article 71: If a production or business operation entity violates the provisions of Paragraph 1, Article 21 of these regulations by failing to provide safety production education and training to the relevant employees, it shall be ordered to make corrections within a specified time limit, and shall be fined not less than 10,000 yuan but not more than 100,000 yuan ; If the violation is not corrected within the prescribed time, the entity shall be ordered to suspend operations for rectification, and shall also be fined not less than 100,000 yuan but not more than 200,000 yuan; the persons in charge who are directly responsible as well as other persons directly liable for the violation shall be fined not less than 20,000 yuan but not more than 50,000 yuan. Article 72: If mining enterprises, metal smelting enterprises, construction companies, shipbuilding and repair enterprises, ship dismantling enterprises, transportation units, as well as entities engaged in the production, operation, storage, and handling of hazardous materials violate the provisions of Paragraphs 1 and 2 of Article 22 of these regulations, and the persons in charge or safety production management personnel fail to pass the required assessments or fail to participate in the mandatory retraining on safety production knowledge, they shall be ordered to make corrections within a specified time limit, and shall be fined not less than 10,000 yuan but not more than 100,000 yuan ; If the violation is not corrected within the prescribed time, the entity shall be ordered to suspend operations for rectification, and shall also be fined not less than 100,000 yuan but not more than 200,000 yuan; the persons in charge who are directly responsible as well as other persons directly liable for the violation shall be fined not less than 20,000 yuan but not more than 50,000 yuan. Article 73: If a production or business operation entity violates the provisions of Article 26 of these regulations and falls under any of the following circumstances, it shall be ordered to make corrections within a specified time limit, and shall be fined not less than 10,000 yuan but not more than 100,000 yuan ; If the violations are not corrected within the prescribed time, the entity shall be ordered to suspend operations for rectification, and shall also be fined not less than 100,000 yuan but not more than 200,000 yuan; the persons in charge who are directly responsible as well as other persons directly liable for such violations shall be fined not less than 20,000 yuan but not more than 50,000 yuan: (1) Failing to organize the identification and assessment of safety risks in order to determine their risk levels ; (II) Failure to formulate control measures for each safety risk individually, and failure to prepare a list of safety risk controls ; (III) Failing to implement hierarchical control in accordance with the safety risk levels ; (IV) Failure to develop specific control plans for major safety risks. Article 74: If a production or business operation entity violates the provisions of Paragraph 1, Article 30 of these regulations by contracting out or leasing its production or business operations, premises, or equipment without fulfilling its relevant safety production responsibilities, it shall be ordered to make corrections within a specified time limit; a fine of not less than 5,000 yuan but not more than 50,000 yuan shall be imposed on it, and a fine of not less than 1,000 yuan but not more than 10,000 yuan shall be imposed on the persons in charge who are directly responsible and other persons directly liable ; If the violation is not corrected within the prescribed time, the entity shall be ordered to suspend operations for rectification. Article 75 The administrative penalties prescribed in these regulations shall be determined by the departments responsible for work safety supervision and management in accordance with their respective responsibilities. Where relevant laws and regulations provide otherwise regarding the authority responsible for imposing administrative penalties, such provisions shall prevail. Chapter 6 Supplementary Provisions Article 76 The term \"small and micro enterprises\" as used in these regulations shall be defined in accordance with **the relevant standards for classifying small and medium-sized enterprises. Article 77 These Regulations shall come into force as of July 1, 2023.
