The coal mine safety supervision agencies established in provinces, autonomous regions, and municipalities directly under the Central Government are responsible for issuing and managing safety production licenses for coal mining enterprises other than those covered by the preceding provisions, and they operate under the guidance and supervision of the **coal mine safety supervision agencies. Article 4: The construction administration departments of the provinces, autonomous regions, and municipalities directly under the Central Government are responsible for issuing and managing safety production licenses for construction enterprises, and they operate under the guidance and supervision of the construction administration department of the State Council. Article 5: The competent departments in charge of the civil product industry at the provincial, autonomous region, and municipal levels are responsible for issuing and managing safety production licenses for civil product manufacturing enterprises, and they operate under the guidance and supervision of the competent department in charge of the civil product industry under the State Council. Article 6: To obtain a work safety license, an enterprise must meet the following work safety requirements: (1) Establish and improve a work safety responsibility system, as well as comprehensive work safety rules and operating procedures; (2) Ensure that investments in safety meet the requirements of work safety; (3) Set up a work safety management department and assign full-time work safety managers; (4) The principal responsible persons and work safety managers must pass relevant assessments; (5) Personnel engaged in special types of work must pass assessments conducted by the competent authorities and obtain certificates for performing such work; (6) Employees must receive proper work safety education and training; (7) The enterprise must participate in work-related injury insurance in accordance with the law and pay insurance premiums for its employees; (8) Factories, workplaces, as well as safety facilities, equipment, and processes must comply with relevant laws, regulations, standards, and procedures regarding work safety; (9) Measures must be in place to prevent occupational hazards, and employees must be provided with personal protective equipment that meets **standards or industry standards; (10) Safety evaluations must be carried out in accordance with the law; (11) Measures must be available for detecting, assessing, and monitoring major hazard sources, along with emergency response plans; (12) There must be emergency response plans for work safety accidents, as well as emergency response organizations or personnel, along with the necessary emergency response equipment and devices; (13) Other conditions specified by laws and regulations. Article 7 Before commencing production, an enterprise shall, in accordance with the provisions of these regulations, apply to the authority responsible for issuing safety production licenses for such a license, and submit the relevant documents and materials specified in Article 6 of these regulations. The authority responsible for issuing safety production licenses shall complete the review within 45 days from the date of receiving the application. If the requirements for safe production as stipulated in these regulations are met, a safety production license will be issued; if such requirements are not met, no safety production license will be issued, and the enterprise shall be notified in writing with an explanation of the reasons. Coal mining enterprises shall, on a mine (shaft) basis, obtain a safety production license in accordance with the provisions of these regulations. Article 8 The format of the work safety license shall be standardized by the work safety supervision and management department of the State Council. Article 9: The validity period of the work safety license is 3 years. If an extension is required for the expiration of the work safety license, the enterprise shall go through the extension procedures with the original authority that issued the work safety license 3 months before the expiration date. If an enterprise complies strictly with the relevant laws and regulations on work safety during the validity period of its work safety license and no fatal accidents occur, then upon the expiration of that license, with the approval of the authority that issued it, no further review will be conducted and the validity period of the work safety license will be extended by 3 years. Article 10 The authority responsible for issuing safety production licenses shall establish and improve a management system for such licenses, and regularly make public information on which enterprises have obtained them. Article 11: The authorities responsible for issuing safety production licenses to coal mining enterprises, construction companies, and manufacturers of civil explosives shall report annually to the corresponding safety production supervision and management departments on the issuance and management of such licenses. Article 12 The work safety supervision and management department of the State Council, as well as the work safety supervision and management departments of the people’s governments of provinces, autonomous regions, and municipalities directly under the Central Government, shall supervise the acquisition of work safety licenses by construction enterprises, manufacturers of civil products, and coal mining enterprises. Article 13: Enterprises shall not transfer or misuse safety production licenses, nor use forged safety production licenses. Article 14: After obtaining a work safety license, an enterprise shall not reduce its work safety standards, and must strengthen daily work safety management while submitting itself to supervision and inspection by the authority responsible for issuing work safety licenses. The authority responsible for issuing safety production licenses shall strengthen supervision and inspection of enterprises that have obtained such licenses. If it is found that these enterprises no longer meet the safety production requirements stipulated in these regulations, their safety production licenses shall be temporarily suspended or revoked. Article 15: Staff members of the authorities responsible for issuing safety production licenses shall not demand or accept any property from enterprises in the process of issuing, managing, and supervising safety production licenses, nor shall they seek any other benefits. Article 16 In accordance with the provisions of the Administrative Supervision Law of the People’s Republic of China, the supervision authorities shall supervise the authorities responsible for issuing safety production licenses and their staff in fulfilling the duties stipulated in these regulations. Article 17: Any entity or individual has the right to report any acts that violate the provisions of these regulations to the authorities responsible for issuing work safety licenses, supervisory agencies, or other relevant departments. Article 18: If a staff member responsible for issuing safety production licenses commits any of the following acts, they shall be given an administrative sanction of demotion or dismissal; if such acts constitute a crime, criminal liability shall be pursued in accordance with the law: (1) Issuing safety production licenses to enterprises that do not meet the safety production requirements stipulated in these regulations; (2) Failing to take legal action when it is discovered that an enterprise is carrying out production activities without having obtained a safety production license as required by law; (3) Failing to take legal action when it is discovered that an enterprise that has obtained a safety production license no longer meets the safety production requirements stipulated in these regulations; (4) Failing to handle reports of violations of these regulations in a timely manner; (5) Requesting or accepting property from enterprises, or seeking other benefits, in the process of issuing, managing, and supervising safety production licenses. Article 19: Those who violate the provisions of these regulations by engaging in production without obtaining a work safety license shall be ordered to cease production, have their illegal gains confiscated, and be fined not less than 100,000 yuan but not more than 500,000 yuan; if a major accident or other serious consequences occur and a crime is constituted, criminal liability shall be pursued in accordance with the law. Article 20: Those who violate the provisions of these regulations by continuing to carry out production after the expiration of the valid period of their safety production license without going through the extension procedures shall be ordered to cease production, required to complete the extension procedures within a specified time limit, have their illegal gains confiscated, and be fined not less than 50,000 yuan but not more than 100,000 yuan. If they still fail to go through the extension procedures and continue to produce after the deadline, they shall be punished in accordance with the provisions of Article 19 of these regulations. Article 21: Those who violate the provisions of these regulations by transferring their safety production licenses shall have their illegal gains confiscated, and shall be fined not less than 100,000 yuan but not more than 500,000 yuan; their safety production licenses shall also be revoked. If the act constitutes a crime, criminal liability shall be pursued in accordance with the law. Those who accept such transfers shall be punished in accordance with the provisions of Article 19 of these regulations. Those who misuse a safety production license or use a forged one shall be punished in accordance with the provisions of Article 19 of these regulations. Article 22: Enterprises that were already in operation prior to the implementation of these regulations shall, within one year as of the date of implementation of these regulations, apply to the authority responsible for issuing safety production licenses in accordance with the provisions of these regulations to obtain such licenses. Those that fail to obtain a safety production license by the prescribed deadline, or those that, upon inspection, do not meet the safety production requirements stipulated in these regulations and continue to operate without such a license, shall be subject to the penalties specified in Article 19 of these regulations. Article 23 The administrative penalties stipulated in these regulations shall be determined by the authority responsible for issuing safety production licenses. Article 24 These Regulations shall come into force as of the date of their publication.

Conduct safety assessments in accordance with the law ； 　　11. Measures for the detection, assessment, and monitoring of major hazard sources, as well as emergency response plans ； 　　12. There is an emergency rescue plan for production safety accidents, as well as emergency rescue organizations or personnel, along with the necessary emergency rescue equipment and apparatus ； 　　13. Other conditions stipulated by laws and regulations.
