Key Point 1: Types of special equipment. Special equipment refers to boilers, pressure vessels (including gas cylinders), pressure pipelines, elevators, lifting machinery, passenger cableways, large-scale amusement facilities, and specialized motor vehicles used within premises (factories), as well as other types of special equipment that are stipulated by laws and administrative regulations to fall under the scope of this law, given their high risk to human life and property safety. (1) [Market access] A licensing system is implemented for the production of special equipment in accordance with the principle of classified supervision and management. Production units of special equipment must meet the following conditions and obtain permission from the department responsible for the safety supervision and management of special equipment before they can engage in production activities. (2) When special equipment leaves the factory, it shall be accompanied by relevant technical materials and documents such as design documents required by safety technical specifications, product quality certification, instructions for installation, use, and maintenance, as well as inspection certificates. In addition, product nameplates, safety warning signs, and their corresponding instructions shall be installed in prominent locations on the special equipment. (3) The design documents for boilers, gas cylinders, oxygen chambers, passenger cableways, and large-scale amusement facilities must be evaluated by an inspection agency approved by the department responsible for the safety supervision and management of special equipment before they can be used for manufacturing. (1) The installation, modification, and repair of elevators must be carried out by the elevator manufacturer or by a unit entrusted to it and that has obtained the appropriate permits in accordance with this law. If an elevator manufacturer entrusts another entity to carry out the installation, modification, or repair of elevators, it shall provide safety guidance and supervision for such installation, modification, or repair, and conduct verification and debugging in accordance with the requirements of safety technical specifications. The elevator manufacturer is responsible for the safety performance of the elevator. (2) The construction units responsible for the installation, modification, or repair of special equipment shall, prior to carrying out such work, inform in writing the department in charge of special equipment safety supervision and management under the people’s government of a municipality directly under the Central Government or a city divided into districts about the planned installation, modification, or repair. (3) After the installation, modification, or repair of special equipment is completed, the construction unit responsible for such work shall transfer the relevant technical documents and materials to the entity that uses the special equipment within 30 days after the completion inspection. The user of special equipment shall include it in the safety technical file of such equipment. Focus 4: Operation of Special Equipment (I) Obligations of Sales Entities (1) The special equipment sold by sales entities must meet the requirements of safety technical specifications and relevant standards; relevant technical documents and materials such as design documents, product quality certification, instructions for installation, use, and maintenance, as well as inspection certificates, must be complete. (2) Special equipment sales units shall establish a system for the inspection, acceptance, and sales records of special equipment. (3) The sale of special equipment produced without a license, special equipment that has not been inspected or has failed inspection, or special equipment that has been explicitly ordered to be phased out and is already scrapped is prohibited. (II) Obligations of the leasing party The responsibility for the use management and maintenance of special equipment during the leasing period lies with the party that leases out such equipment, unless otherwise provided by law or agreed upon by the parties involved. (III) Import of special equipment (1) The special equipment imported must meet the requirements of China’s safety technical specifications and pass inspection ; Those who need a production license for special equipment in our country must obtain such a license. (2) The technical materials and documents accompanying imported special equipment shall comply with relevant regulations; the instructions for installation, use, and maintenance, product nameplates, safety warning signs, and their accompanying explanations shall be in Chinese. (3) When importing special equipment, it is necessary to fulfill the obligation of giving prior notice to the department responsible for the safety supervision and management of special equipment at the place of import. Key Point 5: Safety Management of Special Equipment (1) Entities that use special equipment shall employ such equipment that has been manufactured with a license and has passed inspection. The use of **special equipment that has been explicitly phased out and is already scrapped is prohibited. (2) The user of special equipment shall, prior to the putting into use of such equipment or within 30 days thereafter, register its use with the department responsible for the safety supervision and management of special equipment in order to obtain a use registration certificate. The registration mark shall be placed in a prominent position on such special equipment. (3) The users of special equipment shall establish safety management systems for job responsibilities, hazard control, emergency rescue, etc., and formulate operating procedures to ensure the safe operation of such equipment. (4) The users of special equipment shall establish safety and technical records for such equipment. The safety technical documentation should include the following: design documents for special equipment, product quality certification, instructions for installation and operation/maintenance, certification of supervision and inspection, as well as other relevant technical materials and documents ; Records of regular inspections and periodic self-inspections for special equipment ; Records of the daily usage status of special equipment ; Maintenance records for special equipment and its associated instruments and meters ; Records of operational failures and accidents involving special equipment. (5) The operators of special equipment such as elevators, passenger cable cars, and large-scale amusement facilities that provide services to the public shall be responsible for the safe use of such equipment; they must establish a safety management department for these special devices or assign full-time personnel to handle safety matters related to them ; Other entities that use special equipment shall, depending on the circumstances, establish a special equipment safety management organization or appoint full-time or part-time special equipment safety managers. Key Point 6: Maintenance and Regular Inspection of Special Equipment (1) The entities that use special equipment shall carry out regular maintenance and periodic self-inspections on such equipment, and keep records of these activities. (2) The users of special equipment shall, in accordance with the requirements of safety technical specifications, submit an application for a regular inspection to the special equipment inspection agency one month before the expiration of the valid period of the inspection results. (3) The user of special equipment shall place the regular inspection mark in a prominent position on such equipment. (4) The boiler user shall carry out treatment of the boiler water (medium) in accordance with the requirements of safety technical specifications, and undergo regular inspections by special equipment inspection agencies. Boiler cleaning should be carried out in accordance with the requirements of safety technical specifications, and subject to supervision and inspection by special equipment inspection agencies. (5) The maintenance of elevators shall be carried out by the elevator manufacturer or by a installation, modification, or repair unit that has obtained a license in accordance with this Law. (6) The elevator maintenance unit shall be responsible for the safety performance of the elevators it maintains ; Upon receiving a fault notification, one should immediately go to the scene and take the necessary emergency rescue measures. (7) When special equipment is modified or repaired and a change in its registration for use is required according to regulations, such a change registration must be completed before the equipment can continue to be used. Focus 7: Identification of hazards and troubleshooting of special equipment (1) Safety managers of special equipment shall conduct regular inspections of the condition of such equipment, and any issues identified must be addressed immediately ; In emergency situations, it is possible to decide to stop using the special equipment and promptly report to the relevant person in charge of the unit. (2) Special equipment operators shall immediately report any potential accident hazards or other safety issues identified during operation to the special equipment safety management personnel and the relevant responsible persons of the unit ; When special equipment is not operating properly, the operators of such equipment must take effective measures in accordance with the operating procedures to ensure safety. (3) When special equipment malfunctions or exhibits abnormal conditions, the entity using such equipment must conduct a thorough inspection to eliminate potential hazards before it can be used again. (4) Before putting passenger cable cars and large-scale amusement facilities into use each day, their operating units shall conduct trial runs and routine safety inspections, as well as check and verify the safety accessories and protective devices. (5) If special equipment poses serious risks of accidents, has no value for renovation or repair, or meets other conditions specified in the safety technical regulations for scrapping, the entity using such equipment shall fulfill its obligations under the law to scrap it, take necessary measures to eliminate its functional capabilities, and go through the procedures to cancel its registration certificate with the department responsible for supervising and managing the safety of such equipment. (6) For special equipment that does not meet the scrapping conditions specified in the preceding paragraph and is still fit for use upon reaching its designed service life, it must pass inspections or safety assessments in accordance with the requirements of safety technical specifications, and have its use registration certificate updated before it can continue to be used. For those that are allowed to continue use, measures such as enhanced inspection, testing, and maintenance should be taken to ensure safe use. Key Point 8: Inspection and testing of special equipment (1) The inspection and testing personnel at institutions responsible for the inspection and testing of special equipment must pass assessments to obtain the necessary qualifications before they can carry out such tasks. (2) Inspectors and testers from special equipment inspection and testing agencies shall not work for more than two such agencies at the same time ; Those who change their practice institution shall go through the change procedures in accordance with the law.
