Administrative Penalty Decision Letter of China Coal Shaanxi Yulin Energy and Chemical Co., Ltd. ➤ Document number of the administrative penalty decision: Yu Zheng Zi Gui Chu Zi [2022] No. 208➤ Date of the penalty decision: 11/02/2022➤ Contents of the penalty: Your company is ordered to return the 749,048 square meters of land (equivalent to 1,123.57 mu) that was occupied illegally to Yuyang District **; your company is also required to dismantle, within fifteen days from the date of receiving this penalty decision, the illegal buildings and other structures covering 10,712 square meters on land that does not conform to the original land use plan nor is included in the transitional national spatial plan, so as to restore the land to its original state; furthermore, the illegal buildings and other structures covering 39,182.6 square meters on land that does conform to the original land use plan and is included in the transitional national spatial plan shall be confiscated by your company and handed over to Yuyang District**； A fine of 30 yuan per square meter is imposed on your company for the illegal occupation of 3,839 square meters (equivalent to 5.76 mu) of arable land that was in line with the original land use plan and had been included in the transitional national spatial planning. These projects were completed (no further work was carried out after September 1, 2021), resulting in illegal occupation of land. Upon investigation and verification, the illegal land occupation area amounts to 749,048 square meters (equivalent to 1,123.57 mu), of which: 494,700 square meters (equivalent to 742.05 mu) fall within the scope of the original land use plan and have been included in the transitional national spatial plan. The land types in this category include 3,839 square meters (equivalent to 5.76 mu) of arable land, 308,279 square meters (equivalent to 462.42 mu) of forest land, 88,576 square meters (equivalent to 132.86 mu) of construction land, and 94,006 square meters (equivalent to 141.01 mu) of unused land. The areas occupied by illegal buildings and other structures on forest land, construction land, and unused land are 39,182.6 square meters, 11,180 square meters, and 19,119 square meters respectively. The remaining 254,348 square meters (equivalent to 381.52 mu) do not fall within the scope of the original land use plan nor have they been included in the transitional national spatial plan. The land types in this category include 2,078 square meters (equivalent to 3.12 mu) of arable land, 131,441 square meters (equivalent to 197.16 mu) of forest land, 7,001 square meters (equivalent to 10.5 mu) of construction land, and 113,828 square meters (equivalent to 170.74 mu) of unused land.
