Interim Measures for the Administration of the Catalogue on the Promotion of Advanced and Applicable Technical Equipment in Emergency Management and the Phasing Out of Outdated Technical Equipment Affecting Production Safety

Chapter I General Provisions
Article 1 These measures are formulated in accordance with laws and regulations such as the Work Safety Law of the People’s Republic of China, the Law of the People’s Republic of China on Responding to Emergencies, the Law of the People’s Republic of China on Promoting the Transformation of Scientific and Technological Achievements, and the Law of the People’s Republic of China on Scientific and Technological Progress, with the aim of accelerating the adoption of advanced and applicable technical equipment in the field of emergency management, phasing out those technical equipment that pose serious threats to production safety, and enhancing the capabilities for preventing safety risks and carrying out emergency rescue operations. Article 2 Advanced and applicable technical equipment refers to technologies, processes, materials, and equipment that are technologically advanced, safe and reliable, as well as practical and effective ； Outdated technical equipment for safe production refers to processes and equipment that pose a serious threat to production safety during the production and operation process. Article 3: A catalog system is implemented for the promotion of advanced and applicable technical equipment and the phasing out of outdated technical equipment. A catalog for the promotion of advanced and applicable technical equipment in emergency management (hereinafter referred to as the Promotion Catalog) and a catalog for the phasing out of outdated technical equipment in work safety (hereinafter referred to as the Phasing-Out Catalog) are issued. Article 4: The Ministry of Emergency Management is responsible for the organizational management of the promotion list and the phase-out list within its scope of duties, with the specific tasks being carried out by the Department of Science, Technology and Informatization of the Ministry of Emergency Management. **The Fire and Rescue Bureau and the China Earthquake Administration are responsible for the specific implementation of promoting advanced and suitable technologies and equipment in their respective fields. The Mine Safety Supervision Bureau is responsible for the specific implementation of promoting advanced and suitable technologies and equipment in its field, as well as phasing out outdated technologies and equipment that hinder safe production. Article 5: The promotion catalog is issued once a year, as a general rule. The elimination list is released based on work requirements. Article 6: The work related to the promotion list and the phase-out list shall adhere to the principles of openness, fairness, and impartiality, be carried out in accordance with laws and regulations and proper procedures, and be subject to public supervision. Chapter 2 Promotion Catalog Article 7 The contents published in the promotion catalog include: name of the technical equipment, main performance indicators, primary functions, and applicable scenarios, etc. Article 8: The advanced and applicable technical equipment to be solicited shall meet the following conditions: (1) They shall comply with **laws and regulations as well as industrial policies, and be capable of effectively addressing key issues in critical areas of emergency management. (II) It features advanced key technical indicators, excellent practical performance, and broad prospects for promotion and application. (III) It has typical application examples, with a usage period of over 1 year, and has achieved good safety and social benefits. (IV) The ownership of intellectual property is clear. (5) Any matters not covered shall be subject to the call for submissions. Article 9 The procedures for compiling the promotion catalog include steps such as collection of materials, review and recommendation, formal examination, expert evaluation, comprehensive assessment, solicitation of opinions, and publication. The specific procedures are as follows: (1) Collection of materials: The Ministry of Emergency Management issues a call for submissions, specifying the requirements for such submissions, in order to gather a wide range of advanced and applicable technical equipment. (II) Review and recommendation: Provincial emergency management departments, provincial fire and rescue agencies, provincial mine safety supervision and inspection departments, and provincial earthquake bureaus review the materials within their respective areas of responsibility and then recommend them to the Ministry of Emergency Management ； Relevant departments and bureaus of the Ministry of Emergency Management, the **Work Safety Emergency Rescue Center, institutions affiliated with the ministry, relevant industry associations (societies), and the headquarters of central state-owned enterprises can submit the materials directly to the Ministry of Emergency Management. Before reviewing and recommending, each unit must conduct thorough research and evaluation to ensure the advancement and practicality of the technical equipment being recommended. (III) Formal review: The Ministry of Emergency Management organizes a formal review of the submitted materials; those that do not meet the application requirements will not be accepted. (IV) Expert evaluation: The Ministry of Emergency Management, the **Fire and Rescue Agency**, the **Mine Safety Supervision Bureau**, and the China Earthquake Administration each organize experts to evaluate the advanced and applicable technical equipment that have passed the formal review in their respective fields. The evaluation expert panel shall be composed of technical experts in relevant fields and representatives from user organizations, and must adhere to the principles of fairness and impartiality as well as strict codes of integrity and self-discipline. (5) Comprehensive evaluation: The Ministry of Emergency Management organizes the **Fire and Rescue Bureau**, the **Mine Safety Supervision Bureau**, and the China Earthquake Administration to conduct a comprehensive evaluation of the expert evaluations, eliminates duplicate and overlapping technical equipment, and compiles a draft list for public comments. (VI) Solicitation of opinions: After seeking the opinions of relevant ministries and commissions, the Ministry of Emergency Management publishes a call for opinions to the public through its website, for a period of no less than 30 calendar days; if necessary, another round of public solicitation of opinions and another expert review will be conducted. (7) Publication: The Ministry of Emergency Management issues them separately or in conjunction with the **Fire and Rescue Bureau**, the **Mine Safety Supervision Bureau**, and the China Earthquake Administration, depending on the relevant field. Chapter 3: List of Technologies to Be Phased Out Article 10: The content included in the list of technologies to be phased out includes the names of outdated technical equipment, the reasons for phasing them out, the scope of restrictions, the time limits for phasing them out, and alternative technical equipment. Article 11: The backward technical equipment to be collected shall meet one of the following conditions: (1) It does not comply with **laws and regulations related to work safety, mandatory** standards, mandatory industry standards, and **relevant industrial policies**. (II) The technical equipment is outdated, posing high safety risks and having significant defects, failing to meet the current requirements for safe production. Article 12 The procedures for compiling the elimination list include steps such as collection of materials, formal review, expert evaluation, solicitation of opinions, comprehensive analysis, and publication. The specific process is as follows: (1) Material collection: The Ministry of Emergency Management issues a call for submissions, specifying the detailed requirements. The provincial emergency management departments and provincial mine safety supervision and inspection departments review the materials within their respective areas of responsibility and then submit them to the Ministry of Emergency Management ； The relevant departments and bureaus of the Ministry of Emergency Management, its affiliated institutions, as well as relevant industry associations/academies and the headquarters of central state-owned enterprises can submit the materials directly to the Ministry of Emergency Management. (II) Formal review: The Ministry of Emergency Management organizes a formal review of the submitted materials; those that do not meet the application requirements will not be accepted. (III) Expert review: The Ministry of Emergency Management and the **Mine Safety Supervision Bureau organize experts within their respective fields of expertise to evaluate the submitted materials. The review panel should be composed of technical experts in the relevant fields, who must adhere to the principles of fairness and impartiality as well as uphold standards of integrity and self-discipline. (IV) Soliciting opinions: The Ministry of Emergency Management compiles the results of the expert evaluations to prepare a draft list of entities to be excluded. After seeking opinions from relevant ministries and departments, it makes these drafts available to the public through its website for comments, for a period of no less than 30 calendar days. If necessary, further public consultations and additional expert evaluations will be conducted. (5) Comprehensive evaluation: The Ministry of Emergency Management organizes a comprehensive evaluation of the draft list of items to be phased out, with the aim of revising and improving said list. (VI) Publication: The Ministry of Emergency Management issues it separately or in conjunction with the **Mine Safety Supervision Bureau, depending on the relevant field. Chapter 4 Implementation and Management Article 13 Emergency management departments at all levels, fire and rescue agencies, mine safety supervision and inspection departments, and earthquake management agencies shall actively guide and promote the application of advanced and suitable technical equipment that has been developed. The various reviewing and recommending agencies should conduct random inspections on the application of the advanced and applicable technical equipment that has been recommended for inclusion in the promotion catalog. Any technical equipment that does not meet the requirements for actual use should be reported to the Ministry of Emergency Management without delay. The Ministry of Emergency Management organizes investigations and evaluations; if the facts are confirmed, it issues a public announcement in a timely manner and makes adjustments when releasing the promotion catalog in the following year. The Ministry of Emergency Management organizes an assessment each year of the application of advanced and suitable technical equipment that has been released; the results of these assessments serve as an important reference for compiling lists of equipment to be promoted and for formulating standards for such technical equipment. Article 14: Emergency management departments at all levels, as well as departments responsible for supervising and inspecting mine safety, shall hold those production and operation units accountable in accordance with laws and regulations if they use technical equipment that should be phased out due to posing a threat to safe production. Article 15 Emergency management departments at all levels and mine safety supervision and inspection departments shall, in accordance with relevant laws and regulations, strengthen supervision over the implementation of the phase-out list. The Ministry of Emergency Management organizes random inspections on the application of alternative technical equipment, promptly conducts investigations and evaluations regarding any issues identified, and announces the results once they are confirmed to be true. Chapter V Supplementary Provisions Article 16 These measures shall be interpreted by the Department of Science, Technology and Informatization of the Ministry of Emergency Management. Article 17 These measures shall come into force as of the date of their publication. The \"Administrative Measures for the Catalog of Technologies and Equipment for Phasing Out Outdated and Promoting Advanced Safety Technologies\" (Safety Supervision Administration Office Science and Technology [2015] No. 43) is also repealed simultaneously. Article 18: The Fire and Rescue Bureau, the Mine Safety Supervision Bureau, and the China Earthquake Administration may, as needed for their work, request the Ministry of Emergency Management to initiate the process of soliciting nominations for the promotion list and the phase-out list.
