1.jpg The State Council has recently approved the investigation report on the particularly severe landslide incident that occurred on December 20 at the construction waste disposal site in Guangming New Area, Shenzhen. The State Council investigation team determined that this accident was a particularly serious liability accident in production safety. On December 20, 2015, a landslide occurred at the Hong’ao construction waste disposal site in Guangming New District, Shenzhen, resulting in 73 deaths, 4 people missing, and 17 injuries (3 severe and 14 minor). 33 buildings (24 factories, 3 dormitories, and 6 private residences) were damaged or buried, affecting the production of 90 enterprises and impacting 4,630 employees. The accident resulted in direct economic losses of 881 million yuan. Following the accident, **** and the State Council attached great importance to it; **** issued immediate important instructions, ordering that efforts be made right away to rescue those trapped, to minimize casualties, and to provide proper treatment for the injured and handle the subsequent matters. **The Prime Minister also issued important directives, setting out requirements for rescue and response efforts. Appointed by **** and the Prime Minister, State Councilor Wang Yong led responsible officials from relevant departments to rush to the scene to guide the rescue and handling efforts. Through the efforts of all parties, on January 14, 2016, the accident rescue and on-site handling were completed; 2.78 million cubic meters of soil were removed, and the area that had been inspected and found to be in good condition amounted to 184,000 square meters. 17 injured people received proper medical treatment. The 90 enterprises and 4,630 employees affected by the accident have been properly resettled. On December 25, 2015, on the basis that the investigation team for the \"12•20\" landslide disaster in Shenzhen Guangming New Area under the State Council ruled out the possibility of a landslide and determined that it was not a natural geological disaster, and in accordance with relevant laws and regulations as well as with the approval of the State Council, an investigation team was established to investigate the extremely serious \"12•20\" landslide accident at the waste soil disposal site in Shenzhen Guangming New Area, Guangdong. The investigation team is composed of relevant departments such as the State Administration for Work Safety, the Ministry of Public Security, the Ministry of Supervision, the Ministry of Land and Resources, the Ministry of Housing and Urban-Rural Development, the All-China Federation of Trade Unions, and the People’s Government of Guangdong Province; representatives from the Supreme People’s Procuratorate were also invited to participate. Experts in fields such as planning and design, environmental monitoring, geotechnical mechanics, solid waste management, and law were hired to assist with the accident investigation. The investigation team adhered to the principles of \"scientific rigor, compliance with laws and regulations, seeking truth from facts, and focusing on practical results\" to carry out in-depth accident investigations. Through on-site inspections, evidence collection, simulation calculations, and expert evaluations, the sequence of events, causes, casualties, and direct economic losses resulting from the accident were determined. The nature of the accident and the responsibilities involved were identified, recommendations were made regarding actions to be taken against the responsible individuals and organizations, the prominent problems and lessons learned from the accident were analyzed, and suggestions were put forward to strengthen and improve future work. The investigation team determined that the direct cause of the accident was the lack of an effective drainage system at the Hong’ao landfill site; the water accumulated within the site could not be drained, resulting in the waste soil being supersaturated with water and the formation of a weak sliding zone at the bottom ； Severe overloading and excessive filling led to an increasing downward thrust and reduced stability, causing the waste soil to become unstable and slide out. The large-scale landslide with high potential energy generated tremendous force; coupled with incorrect handling of the emergency situation prior to the incident, this resulted in severe casualties and substantial property losses. The investigation found that Shenzhen Lvwei Company was the winning bidder for the operation and service project of the Hong’ao reception site, and it illegally subcontracted the entire operation and service project to Shenzhen Yixianglong Company. Shenzhen Yixianglong Company carried out the construction of the Hong’ao reception site in violation of regulations, without proper surveying and design ； On-site operation management is chaotic, and the Hong’ao reception site is operated in violation of laws and regulations ； Ignoring the safety risks at the receiving site, and mishandling signs of accidents and hazardous situations. Lin Minwu, Wang Mingbin, and others who have debt relationships with Yixianglong Company actually participated in the operation of the Hong’ao Reception Site project by exchanging their claims for equity. Both companies and the actual operators are responsible for the accident. The investigation found that the Party committees of Shenzhen City and Guangming New Area **failed to properly implement the Party’s and **relevant policies, guidelines, laws, and regulations on work safety; they proceeded with the construction of waste soil storage sites in violation of regulations, and failed to detect or address the problems existing in the relevant departments ； Departments and agencies in Shenzhen responsible for urban management, construction, environmental protection, water affairs, planning, and land use issued approvals and permits in violation of regulations; they failed to carry out their routine supervision duties as required, and did not effectively address the safety hazards existing at the Hong’ao waste disposal site, which were reported by the public ； Guangdong Huaxi Architectural Design Co., Ltd. issued the construction design drawings for the Hong’ao reception site without any design, calculation, or review work, and falsified the date of preparation of those drawings in order to make a profit from it. The investigation team put forward handling recommendations for 110 responsible personnel. Among them, 53 persons have been subject to criminal coercive measures by judicial authorities; these include 34 employees of enterprises and intermediary agencies who were subject to investigation by public security authorities in accordance with the law and subjected to criminal coercive measures, as well as 19 persons suspected of committing duty-related crimes who were investigated by procuratorial authorities and subjected to criminal coercive measures. The investigation team also put forward recommendations regarding 57 individuals held responsible for these issues: it was suggested that 49 of them, including 2 current officials and 1 former official from the Shenzhen Municipal Party Committee and government, should be subject to party and administrative disciplinary actions. Of these, 11 were at the departmental level, 27 at the county or divisional level, and 11 at the section level or below ； It is recommended that written criticism be issued to 2 responsible persons, including the main leaders of the Shenzhen Municipal Party Committee and the municipal ** authorities, while admonitory talks be held with 6 responsible persons from relevant departments in Shenzhen. The investigation team recommends that Shenzhen Yixianglong Company have its relevant licenses revoked in accordance with the law and be fined, and that the company’s main responsible persons shall never again serve as the key officials in any business or production entity in this industry ； Revocate the business license of Lvwei Property Management Co., Ltd. in accordance with the law, confiscate the illegal gains, and impose a fine. Administrative penalties such as confiscation of illegal gains, fines, and revocation of relevant qualifications were imposed on Guangdong Huaxi Architectural Design Co., Ltd. The accident revealed problems and lessons in five aspects: First, the involved company ignored laws and regulations, resulting in extremely chaotic construction, operation, and management ； Second, local authorities fail to administer according to the law, and their commitment to safe development is not strong enough ； Third, relevant departments grant approvals in violation of laws and regulations, with a lack of routine supervision ； Fourth, the handling of construction waste needs to be further regulated, as intermediary service agencies engage in illegal and irregular activities ； Fifth, ignoring reports of potential hazards and failures to investigate them, as well as falsifying information regarding corrective actions taken. In response to the above issues, the investigation team put forward preventive measures and recommendations in 8 areas: first, firmly establish the concept of safe development and improve the safety production responsibility system ； Second, strictly enforce the primary responsibility for work safety and strengthen the foundation of work safety ； Third, strengthen urban safety management and enhance awareness of risk control ； Fourth, enhance the awareness of governing according to law and continuously improve urban management levels ； Fifth, strengthen the management of urban construction waste disposal sites by establishing comprehensive standards, specifications, and management systems ； Sixth, strengthen emergency management work to comprehensively improve emergency management capabilities ； Seventh, strengthen the supervision of intermediary service agencies and regulate their technical service practices ； Eighth, strengthen the identification and resolution of potential accident hazards, as well as the reporting and investigation of such issues, to ensure comprehensive closed-loop management throughout the entire process.
