An employee of the company took the exam to obtain a certification for special operations; they failed both the theoretical and practical parts, as well as the retake. In such a situation, is it necessary to remove them from that position?
One cannot take up the position without a special operations permit; only a basic salary is provided, and if the requirements for that position are not met for two consecutive years, the employer may terminate the employment contract. This is how things are done here; the cost of special operations training and exams is reimbursed by the company if one passes the tests, but one has to pay it out of pocket if they fail – the company will not cover the costs in such cases.
Failing the exam was because the unit work wasn’t done well
In my opinion, it’s completely possible to transfer you to another position: 1. The qualifications required for that position are there merely to meet legal requirements; if you continue to work in that position, the company could be in violation of the law or regulations; 2. Of course, if a company wants to be more considerate, it can temporarily reassign the employee to another position, with the option to have them return to their original role once they obtain the required certification ; 3. For standardized practices, it is best for companies to specify relevant terms in their recruitment requirements, employment contracts, or relevant regulations: such as what qualifications must be obtained ; What should enterprises do if they fail to obtain the qualification certificate? ; In this way, both parties will act in accordance with the agreed terms in the future ; 4. Our company’s policy: If it fails the first time, even a retake does not count as a pass ; Second attempt at the exam: Employees pay out of their own pocket to attend training and obtain the certification; if they fail again, the company will consider transferring them to another position or terminating their employment contract ;
A report was submitted to the HR department requesting that employees work in such positions only after obtaining the necessary certification. The HR department stated that the Quality Supervision Bureau requires that one work in such special positions for half a year before being able to get the certification, and applications can only be submitted at the beginning of each year
That statement isn’t quite appropriate; these days, many children of employees from established petrochemical companies are assigned jobs without going through a competitive process, and it’s difficult for companies to manage them properly when they don’t work diligently.
Transferred away – can’t even pass such an easy exam, and the job isn’t that great either!
