In conducting a current situation assessment, the hazardous factors in enterprises include chemical toxins, dust, noise, etc. However, only chemical toxins were tested during the health checks – is this in compliance with legal or regulatory requirements?
In accordance with the requirements for occupational health examinations, there are three types of occupational hazards present in our environment; only chemical toxins have been tested, which is clearly insufficient.
We have encountered this issue before as well; firstly, when signing an agreement with a qualified hospital, it is necessary to specify the tests that need to be conducted within the company; The second is to request testing again ; Thirdly, with the assistance of the local safety supervision authorities, companies can be avoided from facing penalties; if the hospital fails to make the necessary corrections, it will be the safety supervision authorities who impose penalties on it rather than the company.
1. Do you specify the examination items when entrusting medical and health institutions to conduct routine health check-ups? (If only the specified examination items are carried out, the fees charged by medical and health institutions will be much lower.) 2. The items for occupational health examinations are determined based on an assessment of the factors that pose risks of occupational diseases; examinations must be conducted for all the hazard factors identified in such assessments. The procedures and frequency for occupational health examinations are outlined in the \"Technical Specifications for Occupational Health Surveillance\" (GBZ 188). If you do not specify certain examination items and the medical institution fails to conduct examinations for all the items listed in the assessment of occupational disease hazards, then the examination institution is violating the laws related to the prevention and control of occupational diseases. “Regulations on the Administration of Occupational Health Examinations”: Article 14 Occupational health examination institutions may conduct on-site occupational health examinations within the jurisdiction of the authority responsible for registering their practice. When undergoing occupational health examinations outside, medical imaging tests and laboratory tests are carried out; it is essential to ensure the quality of these tests and to meet the requirements regarding radiation protection and biological safety. 3. If medical and health institutions still fail to conduct the missing examinations that are required, you may file a complaint with the local health and family planning authorities. In accordance with Article 19 of the Measures for the Administration of Occupational Health Examinations, local health and family planning authorities at the county level or above shall strengthen the supervision and management of occupational health examination institutions within their jurisdictions. In accordance with the principle of territorial management, an annual supervision and inspection plan shall be formulated to ensure proper supervision and inspection of occupational health examination institutions. The main contents of supervision and inspection include: (1) the implementation of relevant laws, regulations, and standards ; (II) Status of carrying out occupational health examinations in accordance with the approved categories and items ; (III) Progress of occupational health examinations conducted outside the office ; (IV) Quality control of occupational health examinations ; (V) Results of occupational health examinations, reports on suspected occupational diseases, and notification status ; (VI) Management of occupational health examination records, etc. Health and family planning administrative departments can conduct inspections on the management and control of occupational health examinations; in serious cases, they will impose penalties in accordance with the Law on the Prevention and Control of Occupational Diseases
In this case, it is more common for the enterprise itself to choose the inspection items. As a medical institution, it will not voluntarily reduce the number of examination items; the more examination items there are, the better it is for the institution, with no negative consequences.
I have a question: do the occupational hazard factors in your company, such as chemical toxins, dust, and noise, exist within a single processing area? Do all operators come into contact with all hazard factors at the same time?
A occupational health examination refers to a health check related to the harmful factors to which workers are exposed. If a worker is exposed to only some of these harmful factors, then the health examination will cover only those factors. Testing for harmful factors that are not present in the worker’s working area may not be conducted
It does not meet the requirements; testing should be carried out separately for the three types of hazards present in enterprises, namely chemical toxins, dust, and noise, so that any problems can be detected early and treated promptly.
